우연적 요소를 해결하기 위한 롤즈의 대처 방안에 대한 검토

Abstract

직관적으로 볼 때, 우연적 요소는 상상 가능한 모든 구체적인 사건들에 개입할 여지가 있는 것처럼 보인다. 그러나 다른 한편으로 규범적 영역의 핵심에서는 오직 통제 가능한 요소들만이 놓여야 한다는 칸트적 통제 원리 역시 타당해 보인다. 본 논문에서는 도덕운이라는 이름으로 다루어지는 이 두 직관간의 충돌이 사회적 규범성의 핵심인 정의에서 어떻게 다루어져야 할지를 탐구하기 위해서 통제 원리를 정의관의 핵심 요소로 받아들인 롤즈의 입장을 살펴본다. 이 탐구 과정은 먼저 롤즈가 칸트적 통제 원리를 자신의 정의관을 세우기 위해 적극적으로 사용했다는 점을 밝히는 것으로 시작한다. 다음으로는 이 통제 원리를 어떻게 활용하여 우연적 요소를 대처하려고 시도했는지에 대해서 상이한 입장을 취하는 노직과 쉐플러의 롤즈 해석을 살펴본다. 이 중 노직의 해석이 먼저 거부될 것인데, 이는 그의 분석틀이 임의성에 대한 딜레마를 낳기 때문이다. 받아들여질 입장은 보다 롤즈를 추상적으로 본 쉐플러의 해석이며, 이는 이 해석을 따를 때 롤즈의 정의관이 가치관의 현실적 다원성과 규범적 보편성을 동시에 설명할 수 있는 입장임이 보다 잘 드러나기 때문이다.

Intuitively, coincidental factors are pervasive and they can intervene in every imaginable case. However, we can also easily accept the Kantian Control Principle which asserts that an agents ability of control is the core of normativity. To reconcile the collision between them in the field of political philosophy, this paper will examine Rawls view from A Theory of Justice, which accepts both the Kantian Control Principle and the pervasiveness of Luck. To do this, first, I will clarify the close connection between the Kantian Control Principle and Rawls premises. Then I will review Nozicks and Schefflers interpretation of Rawls solution of matters of luck. Lastly, I will deny Nozicks interpretation and accept Schefflers since the former interpretation brings about a dilemma with regard to luck and the latter can elucidate additional advantages of Rawls solutions which rationalize how we can maintain both the diversity of each person and the universality of social normativity.
