이성의 현실과 이성의 역사적 현실－헤겔 법철학에서 이성과 현실의 문제

Abstract

헤겔의 객관정신론 전체를 포괄하는 법철학에서는 이성의 현실로서 법 이념이 다루어진다. 헤겔에게 있어 법의 이념이란 개념적으로 파악된 이성적 현실이다. 객관정신론의 마지막 항목인 역사철학(세계사)에서는 이성의 역사적 현실이 다루어진다. 법 개념에 대한 사변적 파악을 뜻하는 법철학은 법 개념의 논리적 전개를 서술하는 반면, 세계사는 이른바 세계 속에 실현된 법 개념의 역사적 전개 과정을 서술한다. 이런 맥락에 따라 헤겔의 <법철학강요>에 나타난 이성적인 것, 그것은 현실적이다. 그리고 현실적인 것, 그것은 이성적이다라는 구절은 이성과 현실의 통일을 함축하고 있음을 알 수 있는데, 이 테제의 의미는 그의 역사철학을 고려할 때 분명하게 확인된다. 헤겔의 이러한 이성-현실관은 현실성과의 화해라는 그의 철학관과 밀접한 연관을 갖는다. 이성이 세계 속에 있다는, 또한 이성이 지속적으로 세계 속에 실현되어 왔다는 통찰이야말로 헤겔이 세계사의 철학을 통해 도달한 화해이다.

The Philosophy of Right, which covers the entirety of Hegels theory of Objective Spirit, is concerned with the idea [Idee] of right as the reality of reason. Hegel identifies the idea of right with conceptualized rational reality. He discusses the historical reality of reason in the last part of Objective Spirit, namely World History (philosophy of history). World History describes the historical development of the so-called concept of right realized in the world, while Philosophy of Right, which means the speculative understanding of the concept of right, describes the logical development of the concept of right. In consideration of his philosophy of history, we can ascertain that the statement What is rational is real; and what is real is rational implies the unified understanding of reason and reality. Hegels insight that reason is inherent in the world and that it also is being realized into the world is nothing but reconciliation which has been reached through his philosophy of World History.
