전환기정의 규범의 확산과 그 효과: 한국의 사례를 중심으로

Abstract

본 논문은 한국에서의 전환기정의는 피해자들의 억울함을 해소하고 한국사회에서 전반에 걸쳐 인권의식을 높였다는 점에서 긍정적인 효과가 있었다고 판단한다. 이 글은 다음 세 부분으로 구성된다. 첫째, 국제인권규범과 전환기정의의 관계를 설명한다. 전환기정의는 인권규범의 하위 규범으로 비교적 최근에 등장한 국제규범이다. 전환기정의는 인권규범을 실질적으로 국가별로 적용하는 사례이기 때문에 인권규범을 보다 더 확장시키고 그 영향력을 심화시키는데 기여한 부분이 크다. 둘째, 근대 한국의 역사에 있어 발생한 인권침해 사례들을 소개하고 이를 해결하기 위해 취해진 전환기정의 조치들을 진실위원회의 활동을 중심으로 개괄한다. 셋째, 다양한 전환기정의 정책 중에서 세 가지 가장 규모가 크고 활동이 광범위했던 진실위원회(4.3위원회, 의문사위, 진화위)의 활동과 보고서, 건의사항 등을 중심으로 진실위원회가 희생자와 한국사회 전반에 미친 효과를 분석한다. 위원회의 활동과 그 효과를 매개하는 다양한 작동기제에 대해 분석하고 이 과정에서 나타난 진실위원회 활동의 성취와 문제점을 분석한다.

The history of South Korea was tainted by internal unrest, the Korean War, and four repressive military and authoritarian regimes, which produced many cases of human rights violations. Since democratizing in 1987, South Korea has launched criminal prosecutions, truth commissions, and reparation programs, the second being the most frequently employed choice. I argue that the diffusion of transitional justice norms in South Korea, through domestic advocacy, had a positive impact on South Korean society as a whole by improving the concept and practices of human rights. I support this argument by tracing the key changes transitional justice has made to South Korean society, such as the presidential apology, revision of history textbooks and official documents, excavation and reburial, and creation of a permanent foundation. In addition, I argue that transitional justice has enhanced the political legitimacy of the government by dissociating the current regime from the past, facilitating reform, and bolstering the core values of justice, human rights, and the rule of law.
