대표의 허구에 관한 연구: 토마스 홉스, 칼 슈미트

Abstract

대표의 허구란 대표제 정부와 인민 주권을 매개하는, 근대 민주주의에 특수한 이데올로기를 지칭한다. 본 연구는 특히 토마스 홉스와 칼 슈미트, 그리고 한스 켈젠의 정치사상과 대표제 이론에서 이 허구가 수행하는 역할을 추적한다. 이들 사상가의 공통점은 정치적 대표를 대표자와 피대표자 사이의 동일성이나 일치의 관점에서 정의하는 의회제 민주주의의 이데올로기가 대표제의 위기의 원천이라고 보면서 거부한다는 점에 있다. 그들은 모두 이에 대한 비판을 통해 서로 다른 방식으로 대표의 허구에 관한 정치이론의 재구성에 기여한다. 이러한 관점에서 봤을 때, 대표의 허구는 다음의 세 가지 점에서 현대 민주주의 이론에 공헌한다. 첫째, 대표의 허구는 선거와 대표의 차이를 구별해주면서 대표의 고유한 의미를 제공한다. 선거가 대표자의 선출만을 설명한다면, 대표는 대표자와 피대표자 사이의 간극을 전제로 양자 사이의 긴밀한 상호작용의 과정을 의미하게 된다. 둘째, 대표의 허구는 대표제 정부와 인민 주권 사이의 관계를 매개하는 역할을 수행한다. 대표를 대의로 정의하는 기존의 관점에 따르면 인민 주권은 정치적 대표의 과정으로부터 배제되면서도 제도적 행위자에 의해서만 배타적으로 대표되고 육화된다. 이와 달리 대표에 대한 허구적 접근은 여전히 정부와 주권의 차이를 인정하면서도 양자 사이의 매개가 가능하도록 만든다. 마지막으로 대표의 허구는 민주주의 하에서의 통치자와 피치자 사이의 상이한 역할들을 맡을 수 있도록 해준다. 이를 통해서 시민들의 역할은 단지 통치자를 임명하는 선출권자로 한정되지 않고, 시민들은 통치자의 활동을 지속적으로 평가하는 공적 판단자의 역할을 수행할 수 있게 된다.

The fiction of representation refers to the specific ideology that mediates between representative government and popular sovereignty, two pillars of modern democracy. This study investigates the roles that this fiction plays in the political thought and representation theory of Thomas Hobbes, Carl Schmitt, and Hans Kelsen. They all dissmissed the parliamentarian ideology according to which what political representation meant was the fictitious identity or correspondance between the representatives and the represented. Their critical theory of representation aims at not only the rejection of the representational fiction but also analysis and understanding of the role of this political fiction. This study argues that if properly reconstructed the fiction of representation can contribute to the contemporary democratic theory in three aspects: First, the fiction strengthens the distinction between election and representation and provides the particular meaning of political representation. While election only covers the moment when the representatives are elected, representation refers to the close interaction and communication between the representatives and the represented. Second, the fiction mediates between representative government and popular sovereignty. According to the conventional view of representative government, while the representation of sovereignty is excluded from the institutional arrangement, it is the representative institution that exclusively embodies the sovereign paradoxically. On the contrary, the fiction helps to overcome this contradiction. Third, the fiction of representation allows the political actors to assume the diverse roles. By this, citizens not only bear the role of the electors whose fuction is limited to the selection of their leaders but also indirectly bear the person of the collective judge who passes judgment on the performance of the governing in a continuous manner.
