거래비용이론, 신제도주의, 그리고 제도의 변화 : GATT에서 WTO로의 분쟁해결제도의 변화

Abstract

거래비용이론은 거래비용을 줄임으로써 기대되는 효율성 이익이 특정 제도의 출현과 그 변화에 결정적인 역할을 한다고 주장해 왔다. 거래비용이론을 적극적으로 흡수한 신제도주의 국제정치이론은 국가간 관계를 보다 효율적으로 조직하는 수단으로서 국제제도를 이해하며, 국제제도의 기능적 조직적 특징 및 그 변화과정을 거래비용에 대한 고려와 관련시켜 설명해왔다. 국제제도가 국가간 상호작용의 상이한 단계에 조응하여 담당하는 기능은, 규칙제정, 감시, 분쟁해결, 실행의 네 가지로 구분할 수 있는데, 각각의 기능을 수행함에 있어 국제제도는 집중성과 위임성의 정도에서 폭넓은 편차를 보여주고 있다.

거래비용이론과 신제도주의이론은 국제무역체제의 역사적 변화를 설명하는 핵심적 이론틀을 제공한다. GATT의 분쟁해결기제는 중개의 방식으로부터 비강제적 중재의 방식으로 점진적으로 발전해왔으며, WTO 체제는 강한 구속성과 높은 위임성을 지니는 강제적인 판정기구를 통해 분쟁을 해결한다는 점에서, 이전의 분쟁해결기제와 질적인 차별성을 드러낸다. 무역의 양적 증대와 교역국의 증가, 분쟁의 빈도와 복잡성의 증가로 인해, 외교적 교섭에 의존하는 GATT의 분쟁해결기제는 더 이상 효과적으로 작동할 수 없게 되었고, 따라서 우루과이 라운드 협상을 통해 국가들은 판정에 대한 비토권을 제거하고 분쟁해결절차의 통일성을 확보하며 일방주의를 금지하는 등 분쟁해결의 제도적 틀을 근본적으로 변화시켰다. 이러한 변화의 기저에는 분쟁해결의 거래비용을 줄이고 효율성을 높이고자 하는 국가들의 합리적 고려가 주요하게 작용했다고 하겠다.

In the "transaction costs economics" field, efficiency gains produced by reducing transaction costs have been the key element in explaining the emergence, transformation or demise of institutions. Neo-institutionalism, which is heavily dependent on the transaction cost theory, has contended that the establishment and change of international institutions are fundamentally determined by rational states' efficiency considerations for economizing transaction costs We can categorize international institutions on the basis of their major functions, corresponding to the subsequent stages of state interactions; rule-making, monitoring, dispute settlement, and enforcement. At each stage, the mechanism that institutions perform each function varies considerably in the degrees of centralizaiton and delegation.
