Abstract
본 논문은 국제정치에서 선험적인 당위성을 근거로 한 규범의 문제를 고찰하기 위한 목적으로, 그로티우스의 국제법 사상을 연구하였다. 그 중에서도 본 논문은 그로티우스의 lex caritatis를 연구 대상으로 삼았다.
그로티우스에게 근대성을 부여해온 기존의 해석들이 그로티우스 사상 안에서 발견할 수 있는 소위 비근대적인 요소들을 배제해오면서, 그로티우스의 lex caritatis는 상대적으로 주목받지 못해왔다. 그러나 기존의 연구들은 그로티우스의 일부만을 보고 해석하고 있다는 비판에 직면하고 있으며, 최근에는 그로티우스를 보다 정확하게 이해하기 위해서는 최소주의적 정의 외의 다른 요소들까지 보아야 한다고 문제의식 하에 연구들이 진행되고 있다. 본 연구는 이러한 비판이 정당하다는 입장과 같이 하면서, 그로티우스의 lex caritatis의 해석이 있어야 비로소 그로티우스를 온전하게 해석했다고 할 수 있다고 주장한다.
caritas의 가장 근본적인 의미는 인간의 사회성(sociability)과 관련되어 있다. 사회를 이루는 존재인 인간은 사회 속에서 함께 살아가는 타인을 고려하고 이들을 존중해야 한다. 바로 이 사회성을 가능하게 하는 것이 바로 lex caritatis이다.
그리고 lex caritatis는 다음의 세 가지 기능을 수행한다고 해석할 수 있다. 첫 번째 기능은 좁은 의미의 자연법 혹은 국제법이 허용하는 권리를 행사하지 않도록 자제하는 것이다. 두 번째 기능은 불가피하게 권리를 행사해야 하는 경우, 권리의 엄격함을 완화하는 것이다. 세 번째 기능은 타인이 도움을 필요로 하는 경우, 적극적인 행동을 촉구하는 것이다.
lex caritatis는 기본적으로 인간에게 부여되는 의무다. 그로티우스가 에서 사용하는 개인과 국가의 유비에 기반하면, 공존하고 있는 타인에 대한 고려, 전체 사회에 대한 고려는 곧 공존하는 타국에 대한 고려, 국가들의 상호적인 사회로 확장될 수 있다.
국가로 확장된 le lex caritatis는 국제법과 관련하여 두 가지 역할을 한다고 해석할 수 있다. 첫째, 국제법으로서의 적절함을 판단하는 기준이 된다. 그로티우스는 국제법을 특정 국가가 아니라 모두의 이익을 염두에 두고 만들어진 법이라고 정의한다. 타국 또는 국가들이 이루는 전체 사회에 대하여 고려한 국제법만이 적절한 의미의 국제법으로 인정된다. 둘째, 국제정치 영역에서 적극적인 의미의 정의를 가능하게 한다는 것이다. 그로티우스는 타인을 돕는 전쟁, 인도주의적 개입을 허용한다. 이를 가능하게 하는 것은 lex caritatis라고 할 수 있다.
이러한 점에서, 그로티우스의 lex caritatis는 첫째, 적절한 의미의 국제법과 그렇지 않은 법의 구분 기준이 된다는 점에서 의사주의의 한계를 극복할 수 있다. 둘째, 타인에게 피해를 주지 않을 소극적 의무만을 규정하는 엄격한 의미의 정의를 넘어, 도움을 필요로 하는 이에게 도움을 줄 것을 권고, 명령한다. 타국에의 원조를 허용하고 때로는 명령함으로써, 적극적인 정의를 가능하게 한다고 기대할 수 있다. 이 점에서 전통적인 다원주의적 국제정치 세계관에 변화가 일어나는 오늘날, 유의미한 함의를 제시할 것으로 기대할 수 있다.
To attempt to address the possibility of deontological norms in the field of international relations, this thesis investigates the thought of Hugo Grotius, focusing on the concept of lex caritatis. This thesis asserts that Grotius cannot be fully understood without the understanding of his lex caritatis and that this lex caritatis has important implications for international law.
Conventional interpretations of Grotius has put little significance on lex caritatis. Why is there such little scholarly attention on lex caritatis? Popular interpretations that depict Grotius as a modern thinker intentionally or unintentionally have ignored non-modern aspects of Grotius. However, these interpretations now face the criticism that they dont give faithful interpretation of Grotius. Recent studies put increasingly more attention on various parts of his De Jure Belli ac Pacis. This thesis defends these revised readings of Grotius, arguing that lex caritatis constitutes an important part of the thought of Grotius and his work.
The fundamental meaning of caritas has to do with Grotius famous sociability. Human being as an intellectual animal with desire of society has regards to others: putting others in consideration, interesting themselves in other men and preferring the advantage of many to own single interest. In short, lex caritatis enables society to come into being.
Lex caritatis functions in three ways. Firstly, it urges to forbear claiming rigorous rights narrowly permitted by law of nature or law of nations. Secondly, it mitigates severity of rights when the execution is necessary and inevitable. Thirdly, it urges to give positive help to others.
On the basis of an analogy between the individual and the state, lex caritatis applies to states, too. Likewise, lex caritatis recommends or sometimes commands states to have regard to other nation and respect the advantage of all in general, not a single body in particular. Therefore, lex caritatis in the field of international relations can play two roles: a normative threshold between law of nations properly called and those improperly called and a just cause to help others, especially a justification for humanitarian intervention.
Lex caritatis understood in this way has implications for contemporary international law. First, it can give clues to problems that voluntarism cannot solve without logical leap, such as the existence of jus cogens. Second, lex caritatis can provide justification for global justice, in that it recommends and commands to give positive assistance to others. In these ways, lex caritatis can be said to give significant implications for international law and international relations.
