Abstract
17세기 네덜란드 출신의 국제법학자이자 국제정치사상가인 휴고 그로티우스(Hugo Grotius, 1583~1645)는 흔히 베스트팔렌의 사상가로 일컬어져 왔다. 하지만 한편으로는 그로티우스의 주된 관심이 주권원칙에 기초한 국제관계의 수립에 있었다고 말하기 어렵기 때문에, 다른 한편으로는 역사적으로 실재한 베스트팔렌 조약에 그러한 의미를 부여하는 것 역시 적절하지 않기 때문에 이러한 시각은 재고될 필요가 있다. 그로티우스에 대한 회의주의의 영향력을 강조한 리처드 턱(Richard Tuck)의 혁신적인 해석은 그의 사상의 역사적 의의를 밝히려는 노력에 유용한 단서를 제공한다. 하지만 턱의 해석이 전적으로 만족스럽지는 않다. 특히 그로티우스에 대한 회의주의의 영향력이 거의 전적으로 자기이익 개념을 중심으로 나타났다는 그의 견해에 의문을 제기할 수 있다. 그로티우스가 지적, 정치적으로 가장 왕성하게 활동하던 시기에 유럽 지성계 및 사상계에서 큰 영향력을 발휘한 회의주의는 자기이익 개념을 통해 표출될 수 있는 것보다 훨씬 더 포괄적인 세계관에 기초한 철학 사조였다. 우리는 이러한 철학의 그로티우스에 대한 영향력 역시 훨씬 더 포괄적이었으리라 충분히 합리적으로 추측해볼 수 있다. 몽테뉴를 비롯한 근세 초 회의주의 철학자들은 제한된 능력의 인간이 의연하게 위기에 대처하는 방법이 무엇인지를 탐구하는 것을 가장 중요한 목표로 삼았으며, 그로티우스는 이러한 회의주의의 문제의식을 받아들였다. 그로티우스는 정의로운 전쟁에 관한 앞선 사상가들의 주장을 계승하여 체계화하면서도 이를 그들과는 다른 시각에서 이해했다. 그로티우스는 회의주의자의 관점에서 전쟁이라는 위기를 이해하고 이를 극복할 수 있는 방안을 모색하고자 했다. 이는 그의 정전론에 이전의 정전론과는 다른 성격과 역사적 의의를 부여했다.
Hugo Grotius, a seventeenth-century Dutch scholar of international law and international political thought, has long been associated with the Treaty of Westphalia. This belief, however, needs to be reconsidered in the light of the fact that Grotiuss main interest did not lie in exploring the questions of sovereignty and of international relations based on it. It is also to be reconsidered, because the Treaty of Westphalia that really existed was never geared to address such questions. Innovative interpretation of Grotiuss political thought by Richard Tuck helps us to rethink its historical significance. Yet Tucks interpretation is not entirely satisfactory. In particular, one can raise doubt on his claim that to Grotius, scepticism meant more than anything else the idea of self-interest. In the early seventeenth century when Grotius was intellectually most productive, scepticism was a philosophical thought based on a worldview far more comprehensive than what can be defined in terms of self-interest. It is, therefore, reasonable enough to suppose that its influence upon Grotius was also far more comprehensive. Michel Montaigne and other early modern sceptics tried to solve the question of how human beings, confronted with serious crises, could deal with them without losing their dignity. Grotius inherited and systematized the just war theory proposed by scholars of the previous generation, but he did it in his own way. Grotius as sceptic understood war as existential crisis and tried to tackle with it. This conferred on his just war theory a distinctive character and significance.
