사회보장으로서의 법률구조법 시론

법률구조법은 1986. 12. 23. 제정되고 1987. 7. 1.부터 시행되어 어느덧 30년이란 세월이 흘렀다. 법률구조법의 시행으로 탄생한 대한법률구조공단은 이 기간 동안 조직도 검찰과 완전히 분리되었고, 법률상담 및 소송구조의 규모도 많은 성장을 이룩했다. 최근에는 법률상담과 소송대리 및 형사변론을 넘어서서 임대차분쟁 조정위원회를 만들어 스스로 분쟁을 해결하는 기관으로까지 성장했다.

이러한 대한법률구조공단의 성장은 긍정적인 측면도 많이 있지만, 최근에는 법률구조 분야를 대한법률구조공단이 독과점 하고 있는 것이 아니냐는 우려도 있다. 또한 자격을 가진 변호사가 아닌 구조공단 직원이 법률상담을 진행하는 것이 타당한지에 대한 변호사들의 비판도 제기되고 있으며, 대한법률구조공단이 예산 확보와 규모 확대를 위하여 노동부, 여성가족부 등과의 대규모 사건 유치를 위한 계약 체결에만 몰두하고, 정작 소외된 계층에 대한 법률구조는 소홀한 것 아니냐는 비판도 제기되고 있다.

법률구조와 관련하여 최근 법무부는 마을변호사 제도, 법률홈닥터 제도 등을 시행하고 있고, 서울특별시는 각 동사무소에 변호사가 나와 상담을 진행하도록 하고 있으며, 공익 활동을 전담하는 변호사들도 늘어나고 있고, 인터넷의 발달로 많은 법률 지식을 손쉽게 얻을 수 있는 환경도 도래했다. 이에 법률구조법이 현재 그 역할을 다하고 있는지를 점검하고, 다가오는 미래 사회를 위하여 어떻게 변화하는 것이 좋을지를 고민해야 할 시기가 되었다고 생각한다.

이 연구는 이러한 문제의식에서 법률구조법이 어떠한 사회적, 정치적 상황을 배경으로 하여 탄생하게 되었는지를 살펴보고, 현재 법률구조법에 따른 법률구조의 상황을 살펴본 후, 향후 법률구조법 및 법률구조 제도는 어떻게 변화되는 것이 좋을지를 고민해 보고자 하였다.

그 결과 기존의 논의와는 달리 법률구조법은 재판청구권을 보장하기 위한 것이라기보다는 사회보장의 일부라고 보아야 하며, 이를 위하여 법률구조법이 보호하고 있는 국민의 권리를 법률복지수급권이라고 부르는 것이 바람직하다는 결론을 내리고, 이 권리의 내용, 근거, 한계 등을 검토하여 법률상 권리 개념으로 정립을 시도해 보았다.

또한 법률구조법 및 법률복지수급권의 발전을 위하여 우선 법률복지수급권의 권리자들이 무엇을 원하는지에 대한 수요조사를 하고, 법률복지 서비스 제공자를 어떻게 지원하고, 이러한 지원이 어떻게 효율적으로 수급권자에게 전달될 수 있는지를 고민해 보아야 하며, 이를 위한 몇 가지 방안을 제시해 보고자 했다.

Legal Aid Act as a Social Security

With the enforcement the Legal Aid Act on 1987. 7. 1., the Korea Legal Aid Corporation (hereinafter referred to as the "Corporation") was established and has grown remarkably over the past 30 years, completely separated from the prosecution system. Recently, it has grown from legal counseling, legal treatment, and criminal defense to establishing a committee for arbitration on lease disputes.

The growth of the Corporation is positive, but there are concerns that the Corporation is monopolizing the legal structure sector these days. There are also criticisms from lawyers about the validity of legal counseling by employees of the Corporation, not qualified lawyers

In addition, critics say that the Corporation is only focusing on signing contracts with the Ministry of Labor and the Ministry of Gender Equality and Family to attract large-scale events in order to secure budget and increase size, while neglecting the legal structure of the underprivileged. Regarding the Legal Aid, the Ministry of Justice recently implemented the village lawyer system, the legal home-doctor system, and the Seoul Metropolitan City Government has allowed lawyers to consult with each community office, the number of lawyers specializing in public-interests activities is increasing, and there is an environment in which many legal knowledge can be easily obtained through the development of the Internet.

This study reviews what social and political situation caused the establishment of Legal Aid Act, and present condition of Legal Aid system, and after that consider how the Legal Aid Act and the Legal Aid system should be changed in the future.

As a result, unlike the existing discussion regarded as the right of access to courts, the Legal Aid Act should be regarded as part of the Social Security, and it is desirable to refer to the rights of the people protected by the law as the 'right to legal welfare' and to establish the concept of legal rights by reviewing the contents, grounds and limitations of these rights.

In addition, for the development of Legal Aid Act and the right to legal welfare, the government should first investigate the demand for what the rights want, how to support the providers of legal services, and how such support can be efficiently delivered to the beneficiaries.
