Abstract
본 연구의 목적은 조선 언관제도의 전통 위에서 高宗代 言官 및 言官言論의 실상을 검토하는 한편, 조선의 전통적인 관료제도가 폐지된 1894년 갑오개혁 당시 언관제도가 어떻게 폐지되었으며 그 개념은 어떻게 기억되었는지를 확인하는 것이다.

言官은 諫官이라고도 하며, 고대 중국에서부터 존재했던 유교정치문화의 대표적인 전통이다. 언관은 낮은 직급에도 불구하고 조선시대 붕당정치가 확립되는 과정에서 핵심적인 역할을 하면서 중요한 주체로 부상했다.

그러나 언관은 18세기 탕평정치기에 들어 위축되었다. 탕평군주들은 여러 붕당들이 각자 사대부들의 공론을 대변하여 경쟁·협력함으로써 국가를 통치하는 붕당정치구조 대신 강력한 왕권에 기반하여 국민들을 직접 통치하는 구조를 선호했다. 이러한 구상 속에서 전국 사대부들의 의견을 모아 공론화하여 군주와 대신을 견제하는 역할을 담당했던 언관들이 있을 자리는 없었다. 게다가 儒生을 중심으로 한 공론장으로는 포착할 수 없는 기층 민중의 공론장이 성장하면서, 언관 및 언관언론의 위상은 더욱 축소될 수밖에 없었다.

고종대 언관언론의 경우 주관기관별로는 兩司(사헌부·사간원 공동)가, 언론의 형식별로는 啓辭가 가장 많은 비중을 차지했다. 그런데 계사는 모두 죄인들에 대한 탄핵언론이며, 한 번 계사를 통해 탄핵된 사람은 언관들의 별도의 합의가 있기 전까지는 계사에서 지울 수 없었다. 그 결과 고종대를 기준으로 100년 전에 살았던 사람이 여전히 계사에 형식적으로 기록되어있는 경우가 종종 발견되었으며, 이러한 탄핵 계사가 고종대 전체 언관언론 중 60% 가까이를 차지하고 있었다.

상술한 것처럼 고종대 언관언론의 대부분은 관성적 탄핵이었지만, 당대 정국에 유의미한 논쟁을 불러일으키는 언론들도 소수 존재했다. 이와 관련하여 原任言官을 중심으로 다양한 언론들이 올려진 것이 주목된다. 철종대에 단 4건에 그친 원임언론이 고종대에 100건 가까이 올려졌으며, 그것들 중에는 現任言官들에게서는 거의 찾아볼 수 없는 시무언론이거나 당대 정국에 큰 논쟁을 불러일으킨 논핵언론들이 다수 포함되어 있었다. 이는 現任言官들의 언론활동이 정체된 상황에서, 原任言官이라는 자격을 이용하여 여론을 생산하고 공론장에 참여하려는 집단이 존재했음을 의미한다.

언관이 해체된 이후 언관들의 기능은 都察院, 經筵廳 등으로 나뉘어졌다. 언관의 핵심 기능인 언론기능은 도찰원이 부분적으로나마 승계했으나, 고종과 일본 사이의 갈등 속에서 실제로 발휘되지는 못했다. 결국 1894년 갑오개혁으로 전통적인 언관언론은 종결되었던 것이다.

조선을 근대국가로 개혁하고자 했던 개화파들은 신문, 의회, 정당 등 근대정치의 핵심적인 요소들을 도입하고자 했으며, 이 과정에서 言官이나 鄕會같은 조선의 전통적인 개념들을 활용하였다. 그 연장선에서 1895년 중추원은 근대적 의회와 유사한 기구로 개편되었으며, 독립신문과 독립협회를 중심으로 전통적 공론장을 대체하는 근대적 공론장이 형성되어갔다.

1898년 개화파와 보수파 사이의 논쟁이 격렬하게 발생하는 와중에 中樞院을 활성화시켜야 한다는 논의가 벌어지자, 고종과 보수대신들은 中樞院이 과거의 言官과 동일한 것이라는 논리를 제시하여 중추원에 대한 주도권을 장악하고 개화파들을 압박했다. 개화파들은 이러한 압박에 저항하면서도, 한편으로는 근대적 의회라는 생소한 개념을 조선사회에 전달하기 위해 중추원=언관 논리를 활용했다.

결국 중추원은 개화파들이 애초에 설립한 의도와는 달리 근대적 의회로 발전하지는 못했으나, 중추원을 둘러싼 논쟁 속에서 개화와 보수 양 세력이 나름의 목적을 위해 전통적인 언관개념과 중추원의 의회개념을 연결시키고 있었다. 이는 한국 사회의 제 세력이 전통의 기반 위에서 근대 정치를 수용하려 했던 모습이었다.
The purpose of this study is to examine the realities of Eon-gwan(言官) and Eon-gwan Eonron(言官言論) in the Kojong Period of Joseon, and to find out how the concept and system of Eon-gwan was changed after the abolition of the traditional bureaucratic system of Joseon in 1894. Eon-gwan is also known as Gan-gwan(諫官), it is a representative tradition of the Confucian political culture in which the concept has existed since the Shang period. Though it was low rank, Eon-gwan played a important role to establish Bungdang(붕당) system, so Eon-gwan became a significant position in political system of Joseon.

But Eon-gwan has shrank in earnest in 18th century, Tangpyeong period. The king of Tangpyeong preferred the governing system that absolute monarch reign subjects with supreme power, to the Bungdang system. In their political plan, Eon-gwan, who kept king and high official from dictatorship, had no roles to perform. Furthermore, the counter public sphere of rural people has grown in this time, so that the status of Eon-gwan and their Eonron got seriously decreased.

Most of Eon-gwan Eonron in the Kojong Period were inertial impeachments, and Gyesa(啓辭) was most used form of Eonron. But all of Gyesa was impeachment to criminals, a person who was once impeached through a Gyesa could not be removed from Gyesa until a agreement was reached by the group of Eon-gwan. As a result, people who lived 100 years ago from Kojong period were still found in Gyesa, and these impeachment records accounted for nearly 60% of all the Eon-gwan Eonron in King Kojong.

But there were also a number of Eonron that had a meaningful controversy at that time. In this regard, it is noteworthy that former Eon-gwan posted various Eonron. Only four Eonrons were posted in Cheoljong era, but close to 100 Eonron in Kojong era. Among them, there were many substantive or controversial Eonron that current Eon-gwan in Kojong era hardly posted. This means that there was a group that would produce public opinion and participate in the public sphere by taking advantage of the qualification as former Eon-gwan in the situation where the Eonron activity of current Eon-gwan were only formal.

The function of Eon-gwan has been divided into Dochalwon(都察院), Gyeongyeoncheong(經筵廳) since they were disbanded. Their core function, the Eonron function, was partially succeeded by Dochalwon, but it was not actually demonstrated in the conflict between Kojong and Japan. Eventually, through the Kabo reformation in 1894, the traditional Eon-gwan Eonron was concluded.

Reformists who wanted to reform Korea into a modern state tried to introduce key elements of modern politics such as newspapers, congresses, and political parties, and used the traditional concepts of Joseon, such as Eon-gwan and Hyanghoe(鄕會). In 1895, Jungchuwon(중추원) was reorganized into a similar organization to the modern parliament, and 《The Independent》(독립신문) and Independent Asociations(독립협회) have formed a modern public sphere replacing the traditional one.

In 1898, when the debate between the progressive and the conservative was fiercely controversy, Jungchuwon won attention as a key institution for reformation, and Kojong and the conservative took control of Jungchuwon and pressed the progressive, suggesting that Jungchuwon is the same as Eon-gwan in the past. The progressive resisted the oppression, but on the other hand, they used the logic of 'Jungchuwon = Eon-gwan' to inform Joseon society of the strange concept of modern parliament.

In the end, Jungchuwon did not develop into a modern parliament, unlike the ones originally designed by the progressive, but in the controversy over Jungchuwon, both the progressive and conservative forces link traditional Eon-gwan concepts to Jungchuwon's conception of parliament. This was the situation in which various forces of Korean society tried to accept modern politics on the basis of tradition.
