Analysis of the Maritime Issues Related to Low-Lying Islands in the Light of Climate Change and Rising Sea Levels

Abstract

최근 기후평가는 최선의 상황이 되더라도 금세기 말이면 해수면이 1m 이상 높아질 것으로 예측하고 있다. 주로 남태평양에 위치하는 다수 도서국가들은 해발이 2-3m에 불과, 완전히 잠기지 않더라도 부분적으로 즉각 잠길 치명적인 위험에 처하게 된다. 휘지, 키리바티, 투발루, 렉쉐드위프, 마샬군도, 몰디브제도, 모리셔스, 나우루, 쉐이셀은 머지 않아 바다 밑으로 침몰할 소도서국가들 가운데 일부에 불과하다.

과거 어떤 국가도 자연영토를 잃은 적이 없다고 하는 것은 한편으로 그러한 피해를 입는 국가들을 대한 국제법에 있어서의 맹점이라고 하겠다. 본 연구는 그와 같은 피해를 입는 국가들의 해양법에 관해 세가지 문제를 분석하였다. 첫째, 기후 변화와 해당국가가 속한 여러 해양지역 해수면상승의 효과. 둘째, 해당국가들의 급속히 축소되는 육지와 관련한 주변해양에 대한 관할권 행사여부 문제. 셋째, 해수면 상승이 해당국가를 포함 해양분쟁에 미치는 영향에 대한 문제이다. 끝으로 본 연구는 소멸국가들의 해양공간 보호, 결정을 위해 이용이 가능한 방법을 분석하려고 노력하였다.

Modern day climate assessments, even the most moderate, forecast sea levels rising by more than one-meter by the end of this century. Many low-lying island states, mostly situated in the South Pacific Sea, lie at an average of two to three meters above sea level, putting these nations at an immediate and fatal risk of being partially if not completely submerged. Fiji, Kiribati, Tuvalu, Lakshadweep, the Marshall Islands, the Maldives, Mauritius, Nauru and Seychelles are only some of the small island countries that may very soon disappear under the sea.

No country has ever lost its physical territory before, which may also explain the lacuna in international for the provision of such affected nations. This study engages in an examination of three distinct queries regarding the maritime jurisdictions of these affected nations. Firstly, the effect of climate change and rising sea levels on the different maritime zones of these nations. Secondly, the issue of whether these nations should remain entitled to their surrounding maritime jurisdictions in light of their quickly diminishing terra firma. Thirdly, the question of what effects rising sea levels may have on the maritime disputes involving affected nations. Finally, this study seeks to analyze the methods available to sinking nations to assert and determine their maritime spaces.
