특허권 침해소송에서의 손해액 산정

Abstract

지적재산에 대한 가치산정방식은 전통적인 기법으로 분류되는 비용접근방식, 시장접근방식, 수익접근방식을 기반으로 다양하게 발전하여 왔는바, 특허기술의 가치산정과 관련하여서는 지표산정법, 분할산정법, 몬테카를로산정법, 옵션산정법 등이 등장하였다. 본 논문에서는 이처럼 다양한 형태로 발전해 온 경제학적 가치산정방식들이 특허권 침해소송에서 손해액을 산정함에 있어서도 반영될 수 있을지 여부를 고찰하였다. 특히, 미 판례법상 특허권 침해소송에서의 손해액 산정에 도입되고 있는 경제학적 요소는 우리나라에서의 특허권 침해소송에도 반영될 필요가 있는바, 특허권 침해와 관련하여 보다 실질적인 손해 보전이 이루어지도록 하게 위하여는 일실이익 관련 시장점유율, 수익 증분, 전체 시장 가치, 가격 침식 등을 반영하는 등 합리적 노력을 기울일 필요가 있다고 본다.

The methods of valuation for intellectual property have been developed in various ways on the ground of the traditional methods: cost approach, market approach, income approach. For example, the Surrogate Measures, the Disaggregation Measures, the Monte Carlo Method and the Option Methods for the valuation of patented technology. This paper examined whether the various economic methods for the valuation of patented technology can be used in calculation of the patent damages through reviewing the patent infringement cases of USA and described the related issues of the republic of Korea with a comparative methods which consider market share of lost profits, incremental income, entire market value, price erosion.
