Abstract

This study aimed to determine the characteristic and course of North Korean regime by comparing the transition of North Korean constitution between 1940s and 1970s with that of a Warsaw Pact state, especially East Germany. The core problem of defining North Korea is so-called Universalism versus particularism controversy, which is mainly about whether distinct features of North Korea such as personal dictatorship and hereditary succession are explainable in the basic context of socialism or not. Many existing studies tend to have various conclusions depending on methodology and analytical tool. Out of studies which focused on political history, early regional studies mostly tried to propose proper terminology for North Korean exceptionality. Later comparative socialist studies tried to find the origin of North Korean phenomena inherent in socialist system by comparing North Korea with historical socialist states during Cold War, such as Soviet Union or China. Many studies about legislation were also based on diachronism of which the pivot is stage of socialist development theory. But they focused on description of certain parts that there was no unified conclusion. In order to find possible converging point of these separate studies, this study instead tried to explain the constitutional history associated with politico-historical context. Out of articles, it focused on two things; Relation between state apparatuses inside government structure which the supreme leader could utilize, and the connoted meaning of proclamatory codes described in the preamble or the general provision. It relied upon comparative method which reflects the achievements of later studies. But considering North Korean socialism was a result of transplantation during Soviet military occupation rather than a birthplace of revolution, and that it was also a divided nation, this study chose East Germany for primary target of comparison instead of the Soviet Union and China. On investigation in such terms, this study could find out that while North Korea adopted the Juseok system internally and professed independent route externally in 1972 constitution, stark opposite phenomena occurred in East European core states represented by East Germany, that is, establishment of collective leadership and subordination to the Soviet Union. Meanwhile, it could also discover that militarization, another alleged North Korean attribution, actually had less to do with the army itself but more with the personal dictatorship. From these contextual evidences, this study concludes that two main characteristics suggested by the regional studies, the Suryeong system and Juche ideology brought considerable transformation that at least after 1972 North Korea does not fit with the universality among socialist states, if not completely non-socialist.

본 연구는 1940년대부터 1970년대로 이어지는 체제 초·중기 북한 헌법의 변천과정을 동구 위성국, 특히 동독과 비교함으로써 북한 체제의 성격과 경로를 판단하고자 하였다. 북한을 정의하는 문제에서 핵심은 소위 보편성-특수성 논쟁으로, 1인 독재·권력세습 등 외부로부터 관측되는 북한의 여러 특이한 징표들이 역사상 존재하였던 타 국가들과 마찬가지로 사회주의적 기본 틀 내에서 설명될 수 있는지를 중심으로 한다. 북한 체제의 성격 규명 문제에서 여러 기존 연구는 방법론과 분석틀에 따라 결론이 좌우되는 모습을 보였다. 정치사를 중심으로 하는 연구 중에서 초기의 지역학적 연구는 단일 표본으로서 북한의 특수성에 개념어를 부여하여 설명하려는 시도가 주를 이루었고, 후기의 비교사회주의적 연구는 소련·중국 등 냉전기 사회주의 국가와의 비교를 통하여 사회주의 체제에 내재된 북한적 현상의 근거를 찾으려 하였다. 헌법 등 법제를 중심으로 하는 연구 역시 상당수가 발전단계를 중심으로 한 통시적 흐름에 기초하고 있으나, 각자 특정 부분을 기술하는 데 집중하여 결론에 관한 통일된 맥락은 없었다. 이에 대하여 본 연구는 제각기 존재하는 북한 체제 연구가 수렴할 수 있는 지점을 찾고자, 헌법 조문의 역사적 변화 과정을 정치사적 맥락과 연관지어 설명하려 하였다. 구체적으로 헌법의 여러 구성 조항들 중 통치구조에서 최고지도자가 이용할 수 있던 국가기구 간의 관계, 그리고 헌법전문 또는 총강에 기술된 선언적 규정이 내포하는 의미에 집중하였다. 방법론적으로는 후기의 성과를 반영한 비교방법론을 사용하였다. 다만 북한 체제가 자생적 혁명의 발생지가 아니라 군사적 점령기에 이식된 것이며 또한 분단국가이기도 하다는 특성에 주목하여, 비교대상국으로 소련·중국을 대신하여 북한과 같은 이식체제인 동구 위성국 가운데에서도 마찬가지로 분단국가였던 동독을 선택하였다. 이러한 틀에 맞추어 비교를 통하여 검토한 결과, 북한이 1972년 헌법에서 대내적으로는 주석제를 도입하고 대외적으로는 독자노선을 표방하던 무렵 동독으로 대표되는 동구 중심부에서는 정반대의 현상, 즉 대내적으로는 국가평의회제 등으로 불리는 집단지도체제를 정착시켰고 대외적으로는 대소련 종속 현상이 나타났음을 확인하였다. 그리고 한편으로 외관상 북한의 또 다른 특이성으로 꼽히던 군사국가화 역시 군부 자체보다는 수령제와 더욱 연관이 깊음을 발견할 수 있었다. 이를 정황적 증거로 볼 때, 지역학적 연구에서 처음 주목하였던 양대 특성인 수령제와 주체사상이 유의미한 변형을 가져왔으며 최소한 1972년 이후로는 완연한 비사회주의가 아니더라도 사회주의 진영의 보편성과는 일치하지 않는다는 결론이 도출되었다.
