국제사회의 UN 안보리 대북제재 이행도 분석

Abstract

본 연구의 목적은 국제사회의 UN 안보리 대북제재 이행도와 그에 영향을 미치는 요인을 알아보는 것이다. 북한이 2016∼2017년간 채택된 대북제재 5건에 대하여 일부 해제를 요구한 원인과 배경을 찾아보기 위해서이다. 칸트의 영구평화론은 국가 간 영구적 협력과 평화를 이룩하기 위한 전제 조건으로 민주주의 정치체제, 국제기구에의 적극 참여, 경제적 상호의존을 제시하였다. 이를 바탕으로 2006∼2019년간 제출된 대북제재 이행보고서 602건을 두 가지 차원에서 분석하였다. 첫째, 이행도를 이행강도와 이행범위의 두 가지 차원에서 접근하였다. 이행강도는 ①단순조치 ②기존 국내법 체계 내에서의 조치 ③독자제재나 제재를 위한 새로운 입법 행위 순으로 구분하였다. 이행범위는 결의안의 내용 변화에 따라, 초기 결의안에서 중점을 두었던 ①무기 ②금융과 최근 제재에서 집중된 무역ㆍ인력ㆍ검색ㆍ운송 등의 범위는 ③기타로 묶어 분류하였다. 분석 결과, 국제사회는 기존의 자국 법체계 내에서 안보리 대북제재의 기타 범위 이행을 가장 많이 하고 있음을 확인하였다. 둘째, 이행범위별 이행강도에 영향을 미치는 요인을 설정하여 회귀분석을 실시하였다. 이때 칸트의 영구평화론적 관점을 적용하여, 민주적ㆍ법적ㆍ상업적 평화를 요인별 범주로서 요인들과의 인과관계를 달리 구성하였다. 모든 범위별 이행강도에 민주주의 지수(민주적 평화), PKO분담금(법적 평화), GDP 대비 상품무역량 비율(상업적 평화) 요인들이 통계적으로 유의한 영향을 주는 결과가 도출되었다. 민주 국가일수록, 국제 평화를 위한 기여가 높을수록, 무역 교류가 많은 국가일수록 대북제재 이행도가 높고, PKO분담금 비율 요인이 다른 유효 요인보다 이행강도에 가장 큰 영향을 미친다고 볼 수 있다. 이행강도를 높이기 위해서는 PKO분담금 비율이 높은 국가의 변화를 이끌어내야 한다. 이로써 칸트의 영구평화 범주 체계가 현재 UN 대북제재 이행에서도 지속 연계되고 있음을 확인하였다. 더불어 회원국들은 제재 초기에 비해 후기에서 강도 높게, 그리고 결의안의 내용 변화에 맞춰 제재를 이행하였음을 확인하였다. 특히 UN 회원국들로 하여금 북한 노동자 철수를 요청하는 내용인 2397호 8항은 기타 범위 보고율이 100%이고, 이행강도 2의 비율이 다른 결의안에 비해 유독 높았다. 이는 안보리가 이행보고서 제출 의무를 결의안 내용 전반에 대해 포괄적으로 부과하던 기존 방식과는 달리, 2397호 8항에 대해서만 중간ㆍ최종보고서 제출 기한을 별도로 명시하는 등 구체적인 이행을 촉구하였기 때문인 것으로 판단된다. 한편 2397호 8항 이행보고서의 이행강도가 낮다는 회귀분석 결과는, 북한 해외 노동자가 파견된 국가가 많지 않아 이행강도가 높기 힘들고, 파견국 또한 대부분 북한과 친소관계가 있어 강도가 높지 않을 가능성도 있는 등 여러 요인들이 작용한 것으로 해석된다. 또한 최종보고서 제출 시한도 도래하지 않았기 때문에 미제출 국가들이 많아 결과를 일반화하기는 어렵다. 향후 대북제재가 추가될 경우, 국제사회의 이행도를 높이기 위해서는 세밀한 내용으로 이행을 구체적으로 촉구하는 집중 제재의 형태로 발의될 필요가 있어 보인다.

This study examines how UN member states have implemented the sanctions against North Korea and finds the factors which could affect the strength by scopes with Kantian perspective. A total of 602 implementation reports submitted by UN member states between 2006 and 2019 are analyzed by using contents analysis and multiple regression method. The implementation was approached in two aspects: the strength and scope nexus. Kant's Perpetual Peace suggested active participation in international organizations with democratic systems and economic interdependence to states as the preconditions for achieving peace between nations. Applying Kantian perspective, the category of factors were reconstructed as democratic, legal and commercial peace. The results show that UN member states most implemented the sanctions within their existing legal system and the others scope. And in all areas of implementation, Democratic Index(democratic peace), PKO Rates(legal peace), and Merchandise Trade Rates to GDP(commercial peace) factors are statistically significant effects. PKO Rates affect on the strength of sanctions more than the other factors. To lead the implementation, it requires to elicit changes from the states with high PKO Rates. In addition, member states took more implementation strongly in the later than first, and were doing the sanctions according to the changes in the scope. This confirmed that Kantian Perspective is still linked to the implementation of UN sanctions against North Korea. Especially resolution 2397(8), which calls for the withdrawal of North Korean workers from the member states, has a 100 percent report rate, and the strength is significantly higher than that of other resolutions. This is because it has requested for specific implementation, such as a separate deadline for submission of interim and final reports only for this paragraph. It is unlike the existing method Security Council imposes the obligation to submit the implementation report on the entire resolution. Through this analysis, if additional sanctions are imposed on the North Korea in the future, they need to be proposed in the form of intensive sanctions, including urging the member states to implement the details in order to drive its implementation.
