麗末鮮初의 奴婢-天民 認識과 그 兩面性

Abstract

본 논문은 麗末鮮初 시기 奴婢를 天民으로 인식하는 지배층의 관점이 성립된 배경과 그러한 인식의 兩面性이 갖는 의미를 검토하였다. 이를 통해 성리학 사상에 입각한 노비제 인식을 중심으로 여말선초 시기가 시대적 전환기로서 갖는 역사적 의미를 해명하고자 하였다. 고려후기 노비 문제의 실태에 주목하게 된 士大夫들은 노비에 대한 적절한 救護를 요구하는 한편, 노비의 참람한 행동 또한 억제해야 한다고 보았다. 이들의 두 가지 입장은 충숙왕 후8년 監察司의 禁令에 그 초기 형태를 확인할 수 있고, 고려 말기 신진사대부의 노비제 개혁론에서 더욱 구체화되어 奴婢를 天民으로 보는 인식으로 종합되었다. 조선초기 국가의 노비 정책에서도, 노비를 다른 民과 마찬가지로 대우하려는 정책과 綱常名分의 질서를 확립하여 노비의 참람한 행동을 억제하려는 정책이 함께 나타났다. 이 시기 양반 지배층은 東國의 奴婢法이 箕子 八條法에서 비롯되어 敎化에 도움이 된다고 보았는데, 이는 天民인 노비를 天分에 의한 綱常 질서에서 아래에 놓인 敎化의 대상으로 규정한 것이다. 결국 奴婢를 天民으로 보는 인식은 양반 지배층이 성리학적 綱常名分論을 통해서 자신들의 노비 지배를 정당화하는 토대로 기능했다. 綱常名分의 확립을 통해 노비에 대한 지배권을 확립하고자 했던 양반 지배층의 의지는 경우에 따라서 노비를 國家의 公民으로 대우하고자 하는 國家의 의지와 충돌하기도 하였다. 이처럼 國家와 私家가 노비 지배를 둘러싸고 갈등한 사정은 奴婢-天民 인식의 兩面性과 관련되어 있었다. 私奴라고 해도 합당한 대우를 받아야 한다는 입장에서 國家는 私家의 노비 지배에 개입할 수 있었던 반면에, 양반 사대부들은 天民인 노비야말로 교화의 대상이므로 노비가 강상명분의 질서에서 아래에 위치해야 한다고 주장하면서 국가의 개입을 저지하고자 하였던 것이다.

This study explored the background of the view of Nobi(奴婢) as a Cheonmin(天民) during the late Koryo(高麗) and the early Chosun(朝鮮) and the meaning of the double-sidedness of that view. The purpose of this research was mainly in understanding of the historical meaning of the late Koryo and the early Chosun period focusing on the view of Nobi based on neo-Confucianism(性理學). The newly growing Sadaebu(士大夫), who witnessed the Nobi problem of late Koryo period, argued the proper treatment of Nobi and the suppression against the Nobis presumptuous behaviors. Their double-sided positions on the Nobi problem can be confirmed in the public notice of Gamchalsa(監察司), which was issued in 1339, and were further embodied in the Sinjin-sadaebus (新進士大夫) insistence on reformation of Nobi system, resulting in the double-sided view of Nobi as a Cheonmin(天民) at the end of the Koryo. In this context, the Nobi policy during the early Chosun period was also accompanied by a policy to treat Nobi like other commoners and to restrain Nobis presumptuous behavior by establishing an order of status. In the same period, Yangban(兩班) class regarded Ki Tse(箕子)s eight clauses law (八條法) as the origin of Dongguknobi(東國奴婢), and thought the existence of Nobi was helpful for the edification. The Yangban class perspective on Nobi could be possible because Nobi was defined Cheonmin, the object of edification placed below in the order of Cheonbun(天分). Therefore, the view of Nobi as a Cheonmin was the basis on which the Yangban class justified their domination of Nobi through the order of status set by the teachings of neo-Confucianism. The will of Yangban class to establish control over Nobi sometimes conflicted with that of the state(國家) to treat them as Gongmin(公民). The circumstances in which the state and the Saga(私家) clashed over the rule of Nobi were related to the double-sidedness of the view of Nobi as a Cheonmin. The state wanted to intervene in Sagas control of Nobi, with the view that even if it was a Sano(私奴), it should receive the same reasonable treatment as ordinary people. On the other hand, Yangban class tried to stop the state from intervening, arguing that Nobi, who are Cheonmin, should be placed under the order of status because they are subject to edification.
