Abstract
It has already been six years since the implementation of the Drug Approval-Patent Linkage System, which was introduced in 2007 and came into effect in March 15, 2015, under the influence of the Korea-US Free Trade Agreement. The Drug Approval-Patent Linkage System is a system that seeks to protect patent rights more actively by taking steps to consider whether patents are infringed on an original drug(new drug) in the drug approval review process. It was introduced in hopes of encouraging research and development of new drugs through strong protection of new drug patent holders and allowing generic drug manufacturers to freely use data on the safety and efficacy of new drugs during the patent term, thereby creating a pro-competitive effect that induces rapid introduction of generic drugs after patent expiry.
The purpose of this thesis is to evaluate whether the Drug Approval-Patent Linkage System operates according to its original purpose, and to devise ways to improve it after examining the limitations of the current system. To this end, the regulations and characteristics of each country's Drug Approval-Patent Linkage System were examined, and the regulations of our Drug Approval-Patent Linkage System were reviewed using a comparative methodology.
To start with I reviewed the background, enactment, and revision of the U.S. Hatch-Waxman Act, which became the basis of the Korean Drug Approval-Patent Linkage System historically. In the United States, the Hatch-Waxman Act is applied only to chemical drugs, and the BPCIA(the Biosimilars Price Competition and Innovation Act) was later established to operate separately for biologics. After reviewing the main regulations and features of the BPCIA, the differences between the Hatch-Waxman Act and BPCIA were examined. Next, the Drug Approval-Patent Linkage Systems in Canada and Australia were reviewed, and regulations in China and Taiwan, which the Drug Approval-Patent Linkage were recently introduced, and cases in Europe and Japan, which did not introduce the Drug Approval-Patent Linkage System, were also reviewed.
Since then, the background of the introduction of Korea's Drug Approval-Patent Linkage System, issues and controversy when was introduced, and whether it is applied to biologics were examined, and the main provisions and characteristics of this system stipulated in the Pharmaceutical Affairs Act were identified.
Next, by examining the lawsuits and trials in each country related to the Drug Approval-Patent Linkage System, the effect of the Drug Approval-Patent Linkage System on the dispute resolution procedure was analyzed. After examining the litigation under the Hatch-Waxman Act in the United States, the Supreme Courts precedent on BPCIA interpretation and litigation related Canada's PM (NOC) regulation, and Australia's compensation lawsuit for damages, Korea's patent infringement litigation and judgements were reviewed. In addition, anti-competitive acts such as reverse payment agreements between patent holders and generic drug companies to block the entry of generic drugs into the market were reviewed in detail by examining cases in the United States, Europe, and Korea, and considered whether Monopoly Regulation and Fair-Trade Acts were violated.
Finally, I tried to examine the limitations of the Pharmaceutical Affairs Act, which introduced our Drug Approval-Patent Linkage System, and devise improvements to compensate for the deficiencies. Specifically, the Pharmaceutical Affairs Act is currently applied to both chemicals and biologics, but biologics should be excluded from the scope of application or exceptional regulations should be established.
Under the state-run insurance drug system, the entry of generics is bound to result in a reduction in the original drug price limit, so I analyzed the Supreme Court's ruling on the original drug price cut and examined the significance. In addition, regarding to the revised insurance drug system, I also suggested the need for a policy review of the preoccupation of the drug price of the authorized generic, which is not illegal as of now.
Relating to the provisions of the prohibition of sales and permission for priority sales items in the Pharmaceutical Affairs Act, which reflects our drug approval-patent linkage system, the prohibition of sales is a kind of administrative disposition, which has the same effect as an injunction based on the patent right of the patentee. In the event of prohibition of sales under unfair patent exercise, the original pharmaceutical company should be held liable for damages to the generic pharmaceutical company. On the other hand, for original pharmaceutical companies, it is necessary to revise the conditions for prohibition of sales so that they can selectively file lawsuits against the desired latecomers (follow-on drugs). In the case of permission for priority sales items, the rule that a trial claim filed within 14 days of the initial trial request also satisfies the initial trial condition should be deleted, and only pharmaceutical companies who have requested the initial trial and have received a trial decision in favor of permission for priority sales item should be secured. In addition, it was also proposed to remove the conditions that a trial decision or judgment should be made within 9 months from the date of the notification.
Given the situation in the domestic pharmaceutical industry, where generic/biosimilar pharmaceutical companies are dominant, the Pharmaceutical Affairs Act should be revised and supplemented to encourage research and development and technological innovation of new drugs, while encouraging latecomer drugs applicants to actively fight against new drug patents and accelerating the market entry of late-stage drugs, to increase drug access to patients and to reduce medical costs. Referring to the regulations and precedents related to the Drug Approval-Patent Linkage System in each country, it is necessary to actively utilize the problems and improvements that emerged during the implementation of the system, reflect them in the Pharmaceutical Affairs Act, and improve the system.
한·미 자유무역협정(FTA) 체결의 영향으로 2007년 도입되어 2015년 3월 15일부터 발효된 의약품 허가-특허연계제도가 시행된 지 벌써 6년이나 지났다. 의약품 허가-특허연계제도는 의약품의 허가 심사 절차에서 오리지널 의약품(신약)에 대한 특허권 침해 여부를 고려하는 단계를 둠으로써 특허권을 보다 적극적으로 보호하려는 제도이다. 신약 특허권자에 대한 강력한 보호를 통해 신약의 연구 개발을 장려하고, 제네릭 의약품 제조사는 특허 존속기간 중 신약의 안전성‧유효성 자료를 자유롭게 이용하도록 함으로써 특허 만료 후 제네릭 의약품의 신속한 도입을 유인하는 친경쟁적 효과를 기대하며 도입되었다.
본 논문은 의약품 허가-특허연계제도가 본래의 목적에 맞게 운용되는지 여부를 평가하고, 현 제도의 한계를 살펴본 후 개선방안을 강구하기 위한 것이다. 이를 위하여 각국의 의약품 허가-특허연계제도의 규정과 특징을 살펴보고 비교법적 방법론으로 우리 의약품 허가-특허연계제도 규정을 검토하였다.
우선 한국 의약품 허가-특허연계제도의 기조가 된 미국의 Hatch-Waxman법(해치-왁스만법)의 도입 배경과 제정 및 개정을 연혁적으로 살펴보았다. 미국의 경우 화학의약품에만 Hatch-Waxman법을 적용하고, 바이오의약품에 대해서는 후에 BPCIA(바이오의약품 가격 경쟁 및 혁신법)를 제정하여 구분해서 제도를 운영하고 있으므로, BPCIA의 주요 규정과 특징을 검토한 후, Hatch-Waxman법과 BPCIA의 차이점을 살펴보았다. 이어서 캐나다, 호주의 허가-특허연계제도를 살펴보고, 최근 허가-특허연계제도를 도입한 중국, 대만의 사례와 허가-특허연계제도를 도입하지 않은 유럽이나 일본의 사례도 검토하였다.
이후 한국의 의약품 허가-특허연계제도가 도입된 배경과 도입 시 논란 및 바이오의약품에의 적용 여부 등의 이슈를 살펴보고, 약사법에 규정된 본 제도의 주요 조항과 특징을 파악하였다.
이어 의약품 허가-특허연계제도와 관련 있는 각국의 소송 및 심판들을 살펴보며 허가-특허연계제도의 분쟁해결절차에 대한 영향을 분석하였다. 미국의 Hatch-Waxman법에 따른 소송, BPCIA 해석에 대한 대법원 판례와 이하 주요 규정과 관련한 소송, 캐나다의 PM(NOC) 규정 관련 소송, 호주의 손해배상청구소송 등을 살펴본 후, 한국의 특허침해소송 및 심판을 검토하였다. 또한, 제네릭 의약품의 시장진입을 차단하려는 특허권자와 제네릭 제약사 간의 역지급합의와 같은 반경쟁적 행위에 대해 미국, 유럽, 한국의 사례를 구체적으로 살펴보며 공정거래법 위반 여부를 살펴보았다.
마지막으로, 현재 운영되고 있는 우리 의약품 허가-특허연계제도가 도입된 약사법 규정의 한계를 살펴보고 부족한 점을 보완할 개선방안을 강구하고자 하였다. 구체적으로, 현재 약사법은 화학의약품 및 바이오의약품 모두에 적용하고 있으나, 바이오의약품에 대해서는 적용대상에서 제외하거나 이에 대한 예외 규정을 신설해야 한다.
국가가 운영하는 보험약가제도 하에서 제네릭 진입은 오리지널 약가 상한의 인하를 가져올 수밖에 없으므로, 최근 오리지널 약가상한인하와 관련된 대법원 판결을 분석하고, 그 의의를 살펴보았다. 또한, 개정된 보험약가제도와 관련하여, 현재 불법은 아닌 위임제네릭의 약가 선점에 대해 정책적 검토의 필요성을 제시하였다.
특히, 우리 의약품 허가-특허 연계제도가 반영된 약사법의 판매금지 및 우선판매품목허가 규정과 관련하여, 판매금지는 행정처분의 일종이나 특허권자의 특허권을 바탕으로 하는 가처분과 같은 효력을 가지는 바, 등재 특허에 대한 이의신청 수단을 신설하고, 부당한 특허권의 행사에 기한 판매금지의 경우 오리지날 제약사가 제네릭 제약사에 손해배상 책임을 지도록 하여야 한다. 한편 오리지널 제약사를 위해서는 판매 금지 조건을 정비하여 선택적으로 원하는 후발의약품에 대해서 소송을 제기할 수 있도록 개정할 필요가 있다. 우선판매품목허가의 경우 최초 심판이 청구된 날로부터 14일 이내에 제기된 심판청구도 최초 심판 조건을 만족하는 것으로 보는 규정을 삭제하고, 실제 최초 심판을 청구한 자로서 승소 심결을 받은 제약사만 우선판매권을 확보하도록 하여 그 혜택 대상을 제한하고, 통지받은 날로부터 9개월 내 심결 또는 심판을 받아야하는 조건을 삭제하는 것을 제안하였다.
제네릭 제약사와 바이오시밀러 제약사가 주를 이루는 국내 제약업계 상황을 고려할 때, 의약품 허가-특허연계제도의 장점을 충분히 살려 신약의 연구 개발 및 기술 혁신을 장려하면서도, 후발의약품 신청자로 하여금 적극적으로 신약의 특허에 도전하게 하고, 후발의약품의 시장 진입을 앞당겨, 환자에 대한 의약품 접근성을 높이고 의료비 절감을 추진할 수 있도록 약사법의 관련 조항들을 수정 및 보완하여야 할 것이다. 각 국가들의 의약품 허가-특허연계제도 관련 규정과 판례를 참고하여 제도 시행 과정에서 나타난 문제점과 개선 내용을 적극적으로 활용하여 약사법에 반영하고, 본 제도를 개선시켜 나갈 필요가 있다 하겠다.
