제주도 부동산 투자이민제의 정책변동 과정에 관한 연구

Abstract

"The Immigrant Investor Scheme for Real Estate" is a type of immigration policy that grants permanent residency as an incentive to attract foreign investor, and it was first implemented in February 2010 for foreigners investing in real estate in Jeju Island. At the same time as the system was introduced, it was evaluated as a successful investment attraction policy by attracting a large amount of investment, and it served as an opportunity to introduce the similar scheme in other regions such as Incheon and Busan. However, since the end of 2012, criticism has arisen that Chinese capital is encroaching on Jeju Island's land, and discussions have been made between pros and cons over the existence of the system. After about three years of debate, the policy has been changed to reduce the target area from all area of Jeju island to "tourism complexes", in October 2015, five years and eight months after its implementation. Since then, new investments have dropped sharply. This study analyzed the process by examining various factors surrounding the change in the immigrant investor scheme for real estate in Jeju Island in 2015. This study is significant in that most of the preceding studies related to the immigrant investor scheme for real estate have analyzed the necessity in a specific region or performance after the introduction of the policy, and no studies have dealt with policy changes. In this study, a combined model of the Policy Stream model by John. W. Kingdon and the Advocacy Coalition Framework by Paul Sabatier is used to explain the policy change process. Through the combined model, the explanatory power limitations of a single model were overcome, and more factors related to the policy were analyzed. As an analysis factor, it includes Relatively Stable Parameters, External Subsystem Events, Problem Stream, Policy Stream, Politics Stream, Coalition and beliefs, Policy Entrepreneur, Policy window, etc. For that, various documents were used, including media articles, government reports, press releases, research materials, and minutes of the National Assembly and the Jeju Council on the immigrant investor scheme for real estate from 2007 to October 2015, As a result of analyzing the policy change process of Jeju Island's the immigrant investor scheme for real estate, the factor that had the most decisive influence on policy change was the politic stream represented by the change in public opinion. Jeju is difficult to develop its manufacturing industry due to its geographical limitations as an island. Therefore, Jeju has an economic structural characteristic that the service industry, such as the tourism industry, is dominated. However, the tourism industry needs the initial infrastructure construction and has high risk of investment because performance of tourism industry depends greatly on external factors. For this reason, Jeju Island had difficulty attracting foreign capital for a long time despite various support from the central government. The immigrant investor scheme for real estate was introduced to solve these problems. However, apart from the introduction of the policy, Chinese tourists visiting Jeju Island have soared since 2010 due to changes in Chinese government immigration regulations and diplomatic disputes between China and Japan. Then, as Chinese who run a business for Chinese tourists purchased a number of houses and shops and lived in Jeju Island, conflicts between Chinese and existing residents in Jeju island began to arise. Although houses and shops were not subject to the immigrant investor scheme for real estate, public opinion was formed that the Chinese purchase of real estate was due to the immigrant investor scheme for real estate. Despite the Jeju Provincial Government's explanation and the activities of the Pro-Advocacy Alliance which wants to continue the investment immigration system, negative public opinion has not been resolved, spreading not only within Jeju Island but also nationwide, leading to policy changes. The policy implications of this study are as follows. First, the immigration policy is highly sensitive to residents in that it is a policy that accepts new people living with existing residents. Therefore, when introducing an immigration policy that affects a specific region, it is necessary to enhance transparency so that local residents can obtain accurate information on the policy. Second, if conflicts with local residents arise due to immigration policies for specific regions, measures are needed to manage and resolve conflicts by forming a consultative body in which local residents participate from the early stage of the conflict. Third, it is necessary to be cautious in that changes in the investment immigration system change the investment attraction policy. In the case of immigrant investor scheme for estate in Jeju Island, the relatively short-term change in policy has led to a loss of trust from foreign investors who trusted existing investment incentives, which has confirmed a sharp drop in investment attraction performance since policy changes. Therefore, when changing the policy on the investment immigration system in the future, it is important to closely examine past policy changes.

부동산 투자이민제는 외국 자본을 유치하기 위해 영주권를 인센티브로 부여하는 이민정책의 한 종류로서 우리나라는 2010년 2월 제주도 내 휴양 시설의 개발사업과 관련한 부동산에 투자하는 외국인을 대상으로 처음 시행되었다. 동 제도는 도입과 동시에 많은 투자금을 유치하여 성공적인 투자 유치 정책으로 평가받으며, 제주도 외 인천, 부산 등 다른 지역에서도 부동산 투자이민제를 도입하는 계기가 되었다. 그러나 2012년 말부터 중국 자본이 제주도 땅을 잠식하고 있다는 비판 여론이 발생하며, 제도의 존폐를 둘러싼 찬성과 반대 측의 논의가 전개되었다. 약 3년 간 이어진 논쟁 끝에 제주도 부동산 투자이민제는 시행 5년 8개월 만인 2015년 10월, 투자 대상 지역을 제주도 전역에서 관광단지로 축소하는 내용으로 정책이 변동되었고 그 이후 투자 유치 실적은 급감하였다. 이에 본 연구는 2015년의 제주도 부동산 투자이민제 정책 변동을 둘러싼 다양한 요소들을 살펴봄으로써 그 과정을 분석하였다. 부동산 투자이민제와 관련한 그간의 선행 연구들이 특정 지역에 있어서의 부동산 투자이민제의 도입 필요성이나 도입 이후의 성과를 분석하는 연구가 대다수였고 정책 변동을 다룬 연구는 없었다는 점에서 본 연구의 의의가 있다. 본 연구에서는 정책변동 과정을 설명하기 위해 다중흐름모형과 정책옹호연합모형의 결합모형을 활용하여 단일 모형이 가진 설명력 한계를 극복하고, 제도와 관련한 보다 많은 요소들을 분석하고자 하였다. 분석요소로서 제주도 부동산 투자이민제를 둘러싼 안정적인 외적변수, 역동적인 외부사건, 정책문제 흐름, 정치 흐름, 정책대안 흐름, 옹호연합과 신념체계, 정책선도자, 정책중개자, 촉발기제와 정책의 창을 분석하였다. 이를 위해 2007년부터 2015년 10월까지를 범위로 부동산 투자이민제와 관련한 언론기사, 정부 보고서, 보도자료, 연구자료, 국회 및 제주도의회 회의록 등 여러 문헌 등을 활용하였다. 제주도 부동산 투자이민제의 정책 변동 과정을 분석한 결과, 정책 변동에 가장 결정적 영향을 미친 요인은 여론의 변화로 대표되는 정치 흐름으로 나타났다. 제주도는 섬이라는 지리적 한계로 인해 제조업이 발달하기 어려워 관광업 등 서비스업이 주를 이루는 경제 구조적 특징이 있다. 그러나 관광업은 초기 인프라 구축이 선행되어야 하고 투자금 회수 리스크가 높은 특성이 있어 중앙 정부의 다양한 지원에도 불구하고 제주도는 오랜 기간 외국 자본 유치에 어려움을 겪고 있었다. 이러한 문제를 해결하기 위해 제주도 측의 제안으로 도입된 것이 부동산 투자이민제이다. 그러나 부동산 투자이민제 도입과 별개로 중국 정부의 출입국 규정의 변화 및 중-일간 외교 분쟁의 영향으로 2010년 이후 제주도를 방문하는 중국인 관광객이 급증하고, 중국인 관광객을 대상으로 사업하는 중국인들이 다수의 주택, 상가 등을 구입하면서 중국인과 제주도민과의 갈등이 발생하기 시작하였다. 이렇게 중국인들이 매입한 주택, 상가는 부동산 투자이민제의 적용 대상이 아니었음에도 중국인이 부동산을 구매하는 행위가 부동산 투자이민제 때문이라는 인식이 형성되었고 더 나아가 중국인들이 제주도 땅을 잠식하고 있다는 식으로 여론이 형성되었다. 이에 대한 제주도청의 해명과 투자이민제를 지속하려는 찬성 옹호연합의 활동에도 불구하고 부정적 여론은 해소되지 않았고 제주도 내 뿐 아니라 전국적으로 확산되며, 제주도 부동산 투자이민제의 적용 대상 축소라는 정책 변동으로 이어지게 되었다. 본 연구의 정책적 시사점은 다음과 같다. 첫째, 이민정책은 기존의 주민들과 함께 살아가게 되는 사람들을 받아들이는 정책이라는 점에서 주민들의 민감도가 높다. 따라서 특정 지역에 한정하여 영향을 미치는 이민정책을 도입할 경우 지역 주민들이 정책에 대한 정확한 정보를 취득할 수 있도록 투명성을 제고할 필요가 있다. 둘째, 특정 지역에 대한 이민정책으로 인해 지역 주민과의 갈등이 발생하는 경우 갈등의 초기 단계에서부터 지역 주민이 참여하는 협의체를 구성하여 갈등을 관리, 해소할 수 있는 조치가 필요하다. 셋째, 투자이민제에 대한 변동은 투자 유치 정책을 바꾸는 것이라는 점에서 신중을 기할 필요가 있다. 제주도 부동산 투자이민제의 경우 비교적 단기간 내 정책이 변경됨에 따라 기존의 투자 인센티브를 믿고 투자한 외국인 투자자의 신뢰를 잃게 되었고, 이로 인해 정책 변동 이후 투자 유치 실적이 급감한 모습을 확인할 수 있었다. 따라서 향후 투자이민제에 대한 정책을 다시 변경할 경우 과거의 정책 변동 사례를 면밀히 검토하는 것이 중요하다.
