직업계고 졸업자의 취업 활성화를 위한 법령 제‧개정 방안 연구

Abstract

이 연구의 목적은 직업계고 졸업자 취업 활성화의 법적 근거를 마련하기 위한 방안을 제시하는 데 있었다. 이를 위해 직업계고 졸업자의 취업 활성화를 위한 법적 근거마련의 필요성을 고찰하고, 취업 활성화 관련 법령 및 제도를 분석하고 주요 논의 결과에 대한 전문가 자문을 실시하였다. 이를 토대로 법령 제‧개정 방향에 대해 적용대상자, 취업활성화 방향, 법제화 방식 및 원칙에 대한 내용을 제시하였으며, 법제화 방식에 따라 관련 법령을 개정하여 조항을 추가하는 안과 별도의 법령을 제정하는 방안을 제시하였다. 마지막으로 향후 법령 제‧개정 방안이 실제 추진되기 위해 파급효과 및 실효성, 법령 추진의 현실가능성, 대상자 외의 제3자에 대한 역차별 및 형평성 문제, 그리고 타 법령과의 체계성, 입법 절차 등 다양한 측면이 고려될 필요가 있음을 제언하였다.

The purpose of this study was to suggest a plan to prepare the legal basis for revitalizing employment for vocational high school graduates. To this end, the necessity of preparing a legal basis for job revitalization of vocational high school graduates was considered, the laws and systems related to job promotion were analyzed, and expert advice was provided on the main results of discussion. Based on this, the contents of the applicable subjects, the direction of employment promotion, the method of enactment and the principle were presented for the direction of enactment and revision of the law, and the plan to amend the relevant laws and regulations according to the method of enactment to add provisions and to enact separate laws did Lastly, in order for the enactment and amendment of laws to be implemented in the future, various aspects such as ripple effect and effectiveness, the feasibility of implementing the laws, reverse discrimination against third parties other than the target person and issues of equity, systematization with other laws and regulations, and legislative procedures, etc. suggested that it needs to be considered.
