정무직 공무원의 책무성에 관한 공법적 고찰

Abstract

최근의 여러 논란은 정치적으로 임용되는 공무원의 적절한 역할과 책무에 관한 논의가 우리나라에더 필요하다는 사실을 일깨워주고 있다. 정무직 공무원이라는 개념은 실정 법률상의 개념이기도하지만, 학문상 개념으로 사용될 수도 있다. 즉, 법률상의 분류와는 다소 다를 수 있지만 정치적으로임용되고 정책결정 업무를 담당하는 고위직 공무원을 의미하는 개념으로도 사용될 수 있다. 이것은미국의 political appointee 또는 presidential appointee와 유사한 개념이다. 이러한 정무직 또는 정치적 공무원은 민주주의 국가에서 대의기관의 민주적 정당성을 행정기관에연결하는 민주적 정당성의 연결고리로 기능한다. 정무직 공무원은 자신을 임명한 대통령 또는 국회등 대의기관의 정치적 의사를 관료제에 충실하게 전달하여야 하는 역할을 담당한다. 그리고 부처의장인 경우에는 소관 부처를 통할하여야 하는 역할을 담당한다. 아울러 국민과 직접 소통하는 역할도담당하여야 한다. 이러한 역할로부터 정무직 공무원의 책무성이 도출될 수 있다. 정무직 공무원은대의기관의 정치적 의사를 따라야 하는 책무를 가지고, 소관 부처에서는 직업공무원제를 보장할책무를 가진다. 일반 국민에 대하여는 대응성과 민주성을 높이도록 국민의 의사에 귀를 기울일책무를 갖는다고 할 수 있다.

Recent disputes on the political officials remind us that more discussions on the proper roles and responsibilities of politically appointed public officials are needed in our society. The concept of a politically appointed official is actually a legislative concept, but it can also be used as an academic concept. In other words, although it may be somewhat different from the legislative classification, it can also be used as a concept that means "a high-ranking public official who is politically appointed and in charge of policy-making." This is the equivalent of political appointee or presidential appointee in the United States. These political officials function as a link of democratic legitimacy that connects the democratic legitimacy of the representative body to the administrative agency in a democratic country. It plays a role in faithfully conveying the political intentions of the representative agencies such as the President or the National Assembly that have appointed them to the executive branch. And most of the political appointees are the heads of the relevant ministries and play the role of having to go through the ministries in charge. In addition, it must also play a role in direct communication with the public. From these roles, the accountability of political appointees can be derived. Public officials in the political office have the responsibility to follow the political will of the representative agency, and the competent ministries have the responsibility to guarantee the career civil service system. It can be said that the polical appointees have a duty to listen to the will of the people so as to enhance responsiveness and democracy.
