Abstract
본고에서는 120년의 법학교과과정을 통시적으로 검토하였다. 초기에는 법률가를 신속하게 양성하기 위해 법학교과 중심으로 교육이 진행되었으며, 1909년부터는 체계적으로 전공과 교양이 균형을 이룬 법학교육을 하였다. 조선총독부는 중간관리층을 양성하기 위한 법학교육만을 허용하였지만, 보성전문학교는 이에서 탈피하였다. 또 조선총독부는 경성제국대학을 설립하여 학문으로서의 법학을 추구하였으나 실패하였다. 근대 법학교육은 일본의 영향 아래에 있었다. 해방 후에는 대학교육의 수준을 유지하기 위해 국가가 교육과정에 개입하여 교육내용을 규제하였다. 그래서 법학교육에서도 교양이 중시되었고, 이전의 경험을 바탕으로 교과과정이 편성되었다. 대학의 자율화를 추진한 1995년부터는 법학교육이 확산되었지만 교과과정에는 큰 변화가 없다. 이는 법의 보편성, 법학의 역사성, 강한 외부구속성 때문이다.
In this paper, I review legal curriculums of last 120 years in Korea diachronically. Beginning, curriculums were composed mainly of laws to quickly train lawyers. Legal education was systematically achieved majors and liberal arts since 1909. The General Governor of Imperial Japan was allowed but only for legal education to train middle administrative lawyer, Posung Professional School was to break them up. And the General Governor established the Keijo Imperial University in 1924 and pursued jurisprudence as science but failed. Legal education was under the influence of Imperial Japan in the Modern Korea. After liberation, the Nation regulated the educational process and curriculums of higher educational institu- tions in order to maintain the level of education. So liberal arts were emphasized in legal education too, the curriculum was organized on the basis of colonial experiences. The autonomy of universities was promoted since 1995, and so legal education was spreaded widely, but there are no big changes in the curriculums of jurisprudence. This is because the universality of laws, historicity of juri- sprudence and the strong external shackles.
