개인정보 수집동의에 대한 민사법적 검토

Abstract

코로나로 인한 비대면 플랫폼 이용이 잦아지면서 앞으로의 산업구조는 플랫폼을 중심으로 이루어질 것이라는 예측이 많다. 이러한 플랫폼산업은 특히 개인정보를 수집하는 경우가 많고, 이처럼 수집된 개인정보는 알고리즘이나 인공지능의 발전을 위하여 재이용되는 경우가 많은데, 개인정보를 수집함으로써 산업이 성장하는 등 경제적 가치와 효용이 커짐에도 불구하고 그 개인정보의 수집에 동의한 정보주체 개개인은 별다른 대가를 받지 못하고 있다. 이에 개인정보가 재산적 가치를 갖는지를 중심으로, 개인정보를 수집하고 그 수집에 동의하는 행위가 대가관계에 있는지를 검토하였고, 나아가 개인정보에 대한 수집과 그 동의가 계약법적으로 설명될 수 있는지를 검토하였다. 개인정보를 이용하여 플랫폼상에서 이용할 수 있는 포인트 등을 지급하는 사례, 혹은 개인정보 수집에 동의하면 경품에 응모할 기회를 주는 사례 등에 비추어 일정한 거래관계 하에서 개인정보가 인격적 가치 외에도 재산적 가치를 가질 수 있다는 점을 확인하였고, 이에 근거하여 사업자가 개인정보를 수집하고 정보주체가 이에 동의하는 것은 일종의 유상계약으로 볼 수 있다고 포섭하여 계약법적으로 개인정보 수집동의를 검토하였다. 이와 같이 일정한 거래관계 하에서 개인정보의 재산적 가치를 인정함으로써, 개인정보를 이용한 산업의 발전이 정보주체에게 직접적인 경제적 효용을 줄 것과 함께 정보주체가 보다 주체적으로 개인정보의 이용여부를 결정할 것이 기대되며, 이미 개인정보가 거래에 사용되고 있는 이상 이를 전면적으로 인정하여 정보주체를 보호함과 동시에 산업의 발전을 꾀함이 타당할 것이다.

With the growth of the platform industry, many predict that the future industrial structure will be centered on the platform as the use of non-face-to-face platforms due to COVID-19 becomes more frequent. In particular, these platform industries often collect personal data, and the collected personal data is often reused for the development of algorithms or artificial intelligence. Despite the growing economic value and utility of the industry, the information subject that agrees to collect personal data is not paid much. Therefore, focusing on whether personal data has property value, it was reviewed whether collecting and agreeing to the collection was in return, and furthermore, it was reviewed whether the collection of personal information and its consent could be explained under contract law. Considering the case of paying points available on the platform in return for personal data, it is confirmed that personal information can be considered a paid contract. By recognizing the property value of personal data under a certain transaction contract relationship, it is expected that the development of the industry using personal information will give direct economic profit to the data subject and determine individuals to use personal data more carefully and independently.
