- Abstract
- 우리민사소송법 제202조 제1항에 「확정판결은 주문에 포함한 것에 한하여 기판력이 있다.」고 규정하여 기판력이라는 용어를 사용하였다. 이 기판력이라는 말은 독일과 오스트리 민사소송법에 사용된 Rcehtskraft의 물론 번역어임은 물론이다. 기판력은 원래 확정판결의 후송에 대한 구속력으로 이해되었다.
