- Abstract
- 신상법의 주식회사에 관한 규정은 의용상법의 그것이 대륙법계에 속하고 있음에 대하여 영미법계의 사상과 제도를 대폭 도입하고 있다는 점에 그 특색을 지적할 수 있으나, 주식회사에 있어서의 본래적‧특징적 현상인 기업의 소유와 경영의 분리라는 것이 신법상의 주식회사의 법구조에 한층 더 강하게 전개되고 있음을 아울러 지적할 수 있다.
