Abstract
본질적으로 정책은 사회적 정의의 원칙에 타당해야 한다. 때문에 무엇을 어떻게, 어떤 기준과 절차에 따라서 정책의 부담과 혜택을 정의롭게 나누어 가질 것인가 하는 분배의 기준이나 방법과 절차 등이 현실적인 실천원칙으로 필요하다. 그래서 본 연구는 정책의 분배의 정의를 논의하고 이를 실현하기 위한 실천원칙을 제시하고자 했다. 구체적으로 서양 중심에서 논의되고 있는 분배의 정의에 관한 연구를 논쟁적 수준에서 고찰하면서 동양사회의 실천개념으로서 분배의 정의를 정책균형에의 함의를 중심으로 설명하였다. 이에 따라서 역사적이고 문화적 맥락에서 보다 실천적이고 타당한 분배의 정의를 탐색하고 실천기준을 제안하는 수준에서 상호교섭원칙을 제시하였다. 즉 상호상즉에 의한 정책의 실체와 가치를 확인하고 이것이 상호간에 의존하면서도 방해나 장애가 아닌 창조적인 상호무애를 설명하였다. 이와 같은 상호상즉과 상호의존 및 상호무애 등의 실천원칙이 총체적으로 작용하면서 정책에서 분배의 정의가 실현될 수 있다고 논의하였다. 앞으로 보다 심도있게 그리고 다양한 분야에서상호교섭의 원칙과 방법 등이 연구되어야 보다 타당하고 적실한 실천원칙으로 정책균형에서 분배의 정의를 설명할 수 있을 것이다. 그럼에도 불구하고 본 연구는 지금까지 서양을 중심으로 한 분배의 정의의 전제조건과는 다른 상호상즉과 상호의존 및 상호무애 등을 전제로 하는 상호교섭 원칙을 하나의 논쟁적 수준정도로 제시하였다. Policy, in itself, has a function of distributing available social resources and opportunities. As a consequence, this paper suggests the principle of mutual interpenetration for making practical procedures and methods for these distributive policy activities. Policy can be balanced by multiple dynamic shifts and changes in the line of costs and benefits that are calculated and conditioned by physical and mental policy causations. Those balanced positions can be reached by a balanced-sense embodied by policymakers. In practice, policymaking includes both ex post and ex ante activities for correcting, coordinating, and compensating for unbalanced and/or unjustified burdens and benefits through informed judgment of policy causation and distributive justice. Based on these theoretical arguments and a review of literature on distributive justice in both Eastern and Western philosophy, this paper defines distributive justice as processes and methods of socially harmonized sharing of policy burdens as well as benefits in the continuing activities of policymaking. The practical principle of mutual interpenetration suggested here is based on three premises. It maintains ones own activities and identities without hindering and/or rejecting other's identities (mutual identity). It varies through mutual dependence, creating and producing new worlds that are not isolated, but mutually created (mutual dependence). It depends not through obstruction but through social harmonization (mutual non-obstruction). This mutual interpenetration is not a principle of distributive policy justice discussed by ethical and religious perspectives and/or political philosophy but one applicable to policy balancing strategy even if it is an abstract concept.
