형사사법기관의 조직구성과 운영에 대한 비교연구: 독일과 미국의 법원조직을 중심으로

Abstract

본 연구는 독일과 미국의 형사사법기관인 법원조직의 운영과 구성에 대하여 비교 분석 하였다. 이를 위하여 첫째, 비교론적 관점에서 각 국가의 형사사법기관에 관한 이론을 소개하고 비교를 위한 기준을 추출하고 이를 유형화하였으며, 이에 따라 사법체계, 조직구성과 운영방식으로 나누어 비교분석의 틀을 구성하였다. 둘째, 비교 분석에 앞서 독일과 미국의 형사사법기관인 법원의 조직구성과 운영현황을 살펴보았다. 셋째, 분석틀에서 제시된 기준별로 독일과 미국의 사법체계, 법원조직의 구성과 운영방식을 비교분석하였다. 이를 토대로 결론에서는 우리나라의 사법기관 개편 및 개혁 작업에 적용가능한 시사점을 도출하였다. This study deals with the structures and practices of court systems in Germany and the United States from a comparative perspective. For the purpose, this study introduces the theories of criminal justice systems, from which it draws three categories for a comparative discussion as a research frame: criminal systems, organizational structures of courts and their practices. To help understanding of court systems in the two countries, this study reviews and examines the present states of organizational structures and practices of courts in Germany and the United States. As a main part, this study analyzes the court systems and practices in Germany and the United States comparatively, based on the categories in the research frame. The conclusion in this study makes several applicable suggestions to the judicial reforms in Korea for benchmarking.
