평화와 인권 : 서독 정부의 대동독 인권정책과 대북 인권정책을 위한 합의

Abstract

서독의 대동독 인권정책을 유형화한다면 다음 세 가지로 나눌 수 있다. 첫 번째 유형 (유형Ⅰ)은 대결적 인권정책이다. 그것은 전투적 반공주의에 의거한 정치적 이데올로기 적 비난 공세로부터 공산주의 체제 전복을 위한 대 주민 선전활동과 전략을 말한다. 이 정책은 공산주의 국가의 인권유린을 내세워 공산주의 국가 정부와의 모든 대화와 협상을 원천적으로 거부하며 해당 공산주의 국가를 국내외적으로 범죄국가로 낙인찍는 데 몰두 하는 것이다. 두 번째 유형(유형Ⅱ)은 규범적 인권정책이다. 이 정책의 근저에는 민주주 의적 공산주의 비판이 놓여 있다. 그것은 전투적 반공주의와 냉전적 정치문화에 뿌리를 둔 적대와 대결 정책과는 구분되는 것으로서 원칙적이고 선언적인 차원에서 인권에 대한 관심을 보여주며, 자유와 자기결정, 인권의 보편적 가치와 원칙에 기초해 근본적이고 규 범적인 차원에서 공산주의 체제의 인권유린 상황을 다양한 방식으로 비판하고 개선을 촉 구하면서 동시에 그것이 체제 간 대결과 적대로 치닫는 것을 경계하는 것이다. 마지막으 로(유형Ⅲ) 실용적 인권정책이다. 이 정책의 핵심은 냉전적 대결을 전면 포기하고 체제 의 차이를 인정하면서도 긴장완화와 화해협력 정치의 틀에서 개별 인간의 구체적이고 현 실적인 고통과 운명을 점진적으로 개선하는 것이다. 공산주의 권력자들과 끊임없이 대화 하고 협상함으로써 해결 가능한 구체적 문제들에 집중하는 것이 그 특징이다. 이때 인도 적 문제의 경감이 그 출발이 된다. 1960년대 후반 이후 통일 시까지 서독 정부가 잘 보여준 것처럼 한국정부도 장기적 으로는 대북 인권정책에서 유형Ⅰ과는 거리를 두고 유형Ⅱ와 유형Ⅲ, 다시 말해 규범적 인권정책과 실용적 인권정책의 병행 및 결합 방식을 취해야 할 것이다. 북한 체제와 그 권력자들의 인권유린을 끊임없이 감시, 견제하면서 공식적으로 규범적인 비판을 상시화 하는 한편, 남북 교류와 대화 및 협상의 확대와 심화를 통해 인도적 문제부터 점진적으 로 해결하는 관점을 정착시킬 필요가 있다. 또 북한 인권문제에 대해 실용적 차원의 접 근과 규범적 비판의 차원이 결합될 수 있다는 점, 그리고 인권 비판과 평화 구축 문제가 양립가능하다는 데 정치적 합의와 시민사회의 공유가 확보될 필요가 있다.

The West German policies on East German human rights from 1949 to 1990 can be classified into the following three types. The first type (Type I) was hostile human right policy toward the communist regime. Based on the militant anti-communism and the political and ideological condemnation it is aimed at the overthrow of the communist regime in the GDR through various propaganda activities and strategies. It didnt allowed any official dialogue and negotiation with the East German political leaders to improve the situation of human rights in the GDR. The second type (type Ⅱ) of the normative human rights policy is grounded on the democratic critique of communism. While rejecting the militant anti-communism and Cold War political culture rooted in hostility and confrontation, it showed an interest in freedom, self-determination and human rights as universal values and principles and gave fundamental and normative censure on the human rights abuses in the communist system. Finally, the West German governments in the 1970s and 1980s carried out the practical human rights policy(Type Ⅲ) toward the GDR. The core of this policy was to seek harmony and reconciliation from antagonism and confrontation and, by dong so, to relieve concrete human sufferings and improve the human rights conditions in the GDR gradually and realistically. Constant dialogue with the Communist rulers was essential and desirable. A lot of humanitarian issues could be resolved by negotiations that were focused on each specific issues. Just as the West German governments had done since the late 1960s, in my opinion, the government of South Korea should adopt in the long run both the type Ⅱ and the type Ⅱ human rights policies in parallel and combined fashion, but not the type I. On the one hand, it should constantly monitor human rights abuses of the North Korean regime and clearly criticize North Korean political leaders based on the normative standards of human rights. On the other hand, we must remember that the most important dimension of the human rights policies has something to do with the pragmatic and realistic way. In addition, the German experience shows the importance of the political consensus on the possible combination of the normative and pragmatic dimensions of the human rights policies. It is imperative that various South Korean politicians and NGOs agree among themselves on the coexistence or parallel development strategy of making peace with the communist regime and on the criticism of its human right situation.
