형평성의 개념화

Abstract

1960, 70년대에 행정학계에서 발굴한 형평성 개념은 Rawls의 정의론에 기반하여 이론화되었으며, 그 이후 행정이념으로 수용되었다. 그러나 형평성이 갖는 개념적 잠재력에도 불구하고, 형평성에 대한 연구는 거의 찾아볼 수 없다. 이글은 형평성의 개념적 심화와 외연의 확장을 위해 우선 형평성의 개념구조를 세우는 것이 일차적으로 중요한 과제일 것이라는 문제의식에서 작성된 것이다. 일반적으로 형평성은 규칙의 유연한 적용을 의미한다. 따라서 이글에서는 형평성을 일종의 조절이념으로 설정한다. 그리고 형평성의 기본이념, 원칙, 원리를 구성요소로 하는 개념구조를 구상한다. 형평성의 기본이념은 제몫을 갖게 하는 것이다. 그리고 이러한 이념을 실현하기 위한 원칙으로서 동일범주 동일대우원칙과 다른범주 다른대우원칙을 제시한다. 그리고 각각의 원칙 안에는 범주화의 원리, 비례의 원리, 비교의 원리가 작동하고 있음을 보이고, 이들의 상호작용이 조절을 이루는 과정을 살펴본다. 마지막으로는 형평성의 개념구조를 이론적으로 그리고 현실적으로 적용하는데 있어서의 유용성에 대해 살펴본다. The conception of equity developed by the scientific public administration community in the 1960s and 1970s was founded on Rawls` theory of justice. Equity has been accepted since then as an ideal of public administration. However, few studies have been performed on it despite the conceptual importance and potential of equity. This study was planned considering that the primary theoretical task for deepening and extending the ideal of equity is to formulate a conceptual structure of it. Equity may generally be related to the flexible application of rules and so may be regarded as an adjusting idea. The conceptual structure of equity consists of a basic idea, principles, and operations. The basic idea is a general idea of justice, which one shares. The principles of equity for realizing the basic idea are for affording equal treatment to equal categories and unequal treatment to unequal categories. Three operations-categorization, proportion, comparison-interact in each principle. Theoretically, the conceptual structure of equity can be utilized to analyze, compare, criticize, and evaluate various principles of justice. Practically, it can show public administrators how to deliberate to make just policies in the real world.
