1793년(정조 17) <婢夫定律>

Abstract

婢夫는 良人이 양반가의 비를 처로 삼아 그 양반가에 사역되는 자이다. 처의 주인

과는 신분적 종속관계는 없지만 경제적으로 예속되어 있다. 1793년(정조 17)의 수교

는 비인 妻의 주인[上典]이 婢夫의 행위를 懲治하다가 殺傷 등에 이른 경우에, 처

상전의 형사책임을 감면하는 것이다. 이와 관련된 자료는 ≪일성록≫과 ≪승정원일기≫

등 연대기와 ≪특교정식≫, ≪수교정례≫ 및 ≪청송정례≫ 등 수교자료집에 있다. 이를 종

합하면 수교의 성립 및 그 이후의 과정을 파악할 수 있다. 수교는 핵심적인 내용만

간추리고 또 담당관서와 성립일자를 기재하여 大典, 즉 ≪대전통편≫ 부록의 형태로

정리하였고, 이것이 나중에 대전-≪대전회통≫-을 편찬할 때 부분적인 수정을 거쳐 등

재되었다. 이 수교 때문에 처 상전의 비부에 대한 범법행위는 거의 처벌을 받지 않

았다. 명분과 강상을 강조하여 신분질서와 사회를 유지하기 위한 목적에서 이 수교

가 탄생하였다.

Bibu(婢夫) is a commoner who married a female slave and works for his wifes

lord. Since he is a commoner, he is not subject to his wifes lord legally. However,

he is under control of his wifes lord economically. The King Cheong-Jos Decree

on Female Slaves Husband in A.D. 1793 stipulated that the sentences should be

commuted and remitted if a female slaves lord injures her husband while disciplining

him for misdoings. The main purpose of this King Decree is to maintain the

status system by emphasizing the code of morals. There are plenty of materials concerning

this Decree, for example, chronicles such as Ilseongnok(日省錄; the Kings

Diary) and SeungJeongwon-Ilgi(承政院日記; the Diary of Cabinets), and collections of

the Kings Decrees such as Teuggyojeongsik(特敎定式), Sugyojeongrye(受敎定例) and

Cheongsongjeongrye(聽訟定例). By analyzing these materials, we can know the process

and backgrounds of legislation and later codification. The point of the case was

summarized in the Kings Decree, and the authorities concerned and the date of

promulgation were recorded. It was formulated as a supplement to Daejeontongpyeon(

大典通編) and stipulated in Daejeonhoetong(大典會通) with partial amendment.

Due to this Kings Decree, criminal offences of the female slaves lord against her

husband were rarely punished.
