dc.description.abstract | 이 논문에서는 단시간근로가 전일제(全日制) 근로에서는 불가능한 근로자의 생애
주기에 따른 근로형태를 실현할 수 있는 방식이라는 적극적인 관점에서 단시간근로 에 관한 현행법 규율 내용의 문제점을 살펴보고, 해당 쟁점에 관한 외국의 입법례를 참조하여 단시간근로에 관한 법규제에 대한 접근방식을 근본적으로 재편하여야 한 다는 내용을 제시하고 있다. 단시간근로에 관한 현행법의 규제방식은 통상근로자에 대한 근로기준법상의 보호 를 제외하거나 축소하는 형태로 이루어져 있으며, 하나의 단행법에서 체계적으로 규 율하는 방식 대신 다양한 개별법에서 단편적으로 규율하고 있는 점에서 문제가 있 다. 나아가 주 15시간 미만의 현저하게 근로시간이 짧은 단시간근로자의 경우 합리 적 근거 없이 주휴일, 연차유급휴가, 퇴직금지급의 대상에서 제외되어 있는 점, 연차 유급휴가를 일(日) 단위가 아니라 시간단위로 부여하도록 규율하여 국제노동기준에 반할 뿐만 아니라 단시간근로자에 대해 사실상 연차유급휴가권을 부정하는 효과를 낳고 있는 점, 통상근로자의 단시간근로자로의 전환청구권이 일․가정양립지원을 위해서만 인정되고 일반적인 상황에서는 인정되지 않음으로써 여성이 지배적인 비 율을 차지하는 단시간근로에서 여성고용 확대에 부정적인 영향을 줄 수 있는 점 등 을 문제로 제시하고 있다. 이 논문은 1일 8시간 근로 주 40시간 근로를 하는 전일제근로자를 원칙적인 적용 대상으로 하는 노동관계법상의 보호를 축소하는 방식으로 단시간근로를 규율하는 접근방식에서, 단시간근로의 특수성과 적극적 의의를 감안한 독자적인 규율방식으로 전환하여야 하며, 그 구체적인 방안으로서 단시간근로 보호에 관한 단행 법률의 제 정을 제안하고 있다. This article analyzes various problems of present legal framework of part-time work from the perspective that individual employees are able to substantialize their life cycle better with part-time work rather than full-time work; and proposes to reorganize the approach to the legal framework of part-time work by referring to the examples of foreign legislation in the same issues. Part-time work is regulated by various labor related acts instead of single act focusing solely on part-time work. The form of regulation is to exempt or reduce the protection guaranteed by Labor Standards Act. These characteristics of present legal regulation of part-time work raise numerous problems. Further examples of problems are as follows: part-time employees of less than fifteen weekly work hours are exempted from weekly holiday, annual leaves and severance pay without reasonable grounds; part-time workers are substantially deprived from the right to annual leaves because annual leaves are operated by time-based not by day-based, which constitutes the violation of international labor standards; and the right to request part-time work of regular employee is acknowledged only under work-life balance program and denied in ordinary bases, which has bad influence on expanding women employment under the circumstance that the ratio of women workers dominates in part-time work. Present legal regulation as to reducing the range of protection under current labor related acts which mainly applies to full-time employees with eight hours of work in a day and forty hours of work in a week. This form of regulation has to be changed to independent system which considers the distinct characteristics of part-time work and its significance. This article propounds the legislation of single act on protection of part-time work. | - |
