한국과 일본의 증거개시제도 비교연구

Abstract

한국은 2008년 1월부터 한국형 배심재판제도를 시작하였다. 일본은 2009년 5월부터 재판원재판이라는 형태로 시민참가 재판제도를 시작하였다. 참가형태에 약간의 차이가

있음에도 불구하고 시민이 형사재판에 직접 참가한다는 점에서 한국과 일본의 형사

사법제도는 커다란 변혁을 맞이하고 있다. 재판에 참가한 시민의 오판을 방지하고 생업에 조속히 복귀할 수 있도록 하려면 집중심리가 필요하다. 한국과 일본에서 이를 위하여 공통적으로 마련한 장치가 증거개시제도이다. 본고는 한일 양국의 증거개시제도를 비교, 검토함으로써 한국의 증거

개시제도에 대한 개선점을 도출함을 목적으로 하고 있다. 논문은 증거개시제도의 법적 성질, 증거개시의 진행순서, 증거개시의 대상과 범위 등을 중심으로 한일 양국의 제도를 비교한 다음, 양국의 판례에서 나타나는 최근의 새로운 움직임을 비교 고찰하고 있다. 결론으로, 필자는 한국의 증거개시제도가 시민 참여의 활성화라는 관점에서 새로이 정비되어야 한다는 주장을 제기하고 있다.

The jury trial of Korean style started in January, 2008. The citizen participation in the criminal justice system in the form of the mixed jury system of Japanese style (Saibanin Saiban) started in May, 2009 in Japan. Two countries are undergoing a major change in the criminal procedure by letting their citizens participate in the criminal procedure. In order to prevent any misjudgments and help citizen participants return to work from their jury duties as soon as possible, it was necessary to hold a concentrated proceeding in the court. As a result the discovery system of criminal evidence was set up in Korea and Japan. This article compares the discovery system of criminal evidence of Korea and Japan with respect to its legal nature, procedural aspects, and ranges. New trends observed in leading cases from the two countries are also discussed. This paper argues that the discovery system of criminal evidence of Korea needs a revision that can promote citizen participation in the criminal procedure.
