dc.description.abstractThis article presents an American legal perspective on the ROK Penal Code. The emphasis is on certain sections of the Code that differ dramatically from the mainstream of contemporary American criminal law including several provisions that should be revised in order to strengthen democracy and better protect human rights in South Korea. The article concludes by suggesting some modest changes to the Code in the name of law reform.-
