국회의원 여성할당제 채택의 정치적 동인 분석

Abstract

이 연구는 2004년에 비례대표 후보자에 대한 50% 여성할당제가 채택될 수 있었던 동인을 밝히는 것을 목적으로 한다. 여성할당제에 대한 기존의 연구들은 할당제 채택 요인으로 여성계의 동원과 압력, 국제조직과 국제규범의 압력, 평등이나 공정성과 같은 정치규범의 영향력, 정치엘리트들의 전략적 이익 등에 주목해 왔다. 한국의 할당제 채택과정에 대한 연구는 베이징 행동강령과 같은 국제적 규범의 압력과 여성계의 동원을 주로 강조함으로써, 상대적으로 정치권의 전략적 이익이라는 측면을 간과해 왔다. 한국이 도입한 할당제는 법적 의무할당제이므로, 입법의 의사결정권자인 국회의원의 전략적 이익과 선택이라는 측면이 매우 중요하다는 것이 이 연구의 주장이다. 2002년 제16대 대선 이후의 불법정치자금 사건이 터지면서 정치권은 국민들로부터 대대적인 정치 개혁의 요구에 직면하였다. 또한 제17대 총선을 앞두고 국회의원 정수를 기존의 273인에서 299인으로 26인 증원시키고 싶었던 정치권은 의석증가의 명분을 필요로 하였다. 50% 여성할당제는 국민들의 정치개혁 요구에 대한 대응과 의석증가의 명분으로 이용되었다.물론 여성계의 압력이나 국제규범의 영향력도 50% 여성할당제의 채택에서 상당한 역할을 했음에 틀림이 없다. 그러나 제도변화에 대한 외부의 압력이 아무리 강해도 당시의 정치적 맥락과 정합성을 갖지 못하거나 의사결정권자의 전략적 이익에 반한다면 제도변화는 어려울 것이다. 따라서 이 연구는 50% 여성할당제가 채택될 수 있었던 동인에는 여성계의 압력뿐만 아니라, 정치개혁에 대한 국민들의 강한 요구, 그리고 무엇보다도 국회의원의 전략적 이익이 있었음을 강조한다.

The purpose of this research is to analyze the dynamics of the adoption of gender quota system in Korea, 2004. To explain the adoption of quota system, studies around the world focuse on women mobilization, international norms and spread through transnational sharing, emerging notions of equality and representation, and political elites strategic interests. The type of quota policy of Korea is the legislative quotas, which is instituted through the amendment of law or constitution. Thats the reason political elites strategic interests has played very important role in Korean case. After the 16th Presidential election, illegal electoral fundraising of the presidential candidate provoked the strong demand of olitical innovation from the civil society. As this political context was compatible with the members strategic interest (justification for the increase of seats from 273 to 299), 50% gender quota for PR party list could be adopted. The argument of this research is not to deny the importance of women mobilization for quotas, but to say however strong the pressure for the change of policy from the civil society, it is impossible to change the political rule of game without fitting the political context and political elites interests.
