준대통령제의 개념과 실제

Abstract

준대통령제에 대한 국내학계와 해외학계의 이해의 간극이 크다. 이 글은 지난 30여 년의 기간 동안 이루어진 준대통령제에 대한 연구의 성과를 비판적으로 소개함으로써 이러한 이해의 간극을 메꾸고자 하는 비판적 리뷰의 성격을 가지고 있다. 준대통령제는 뒤베르제에 의해 처음 소개된 이후, 냉전의 해체에 의한 수적 확산에도 불구하고 많은 개념상의 논쟁을 불러일으켰다. 이와 같은 혼란의 이면에는 대통령의 상당한 권력이라는 요건이 가지는 모호성이 존재한다. 이에 최근에는 이를 온전히 제거한, 보편선거를 통해 고정된 임기로 선출된 대통령이 의회에 책임을 지는 수상 및 내각과 공존하는 체제라는 엘지에 의한 재정의가 보편적으로 받아들여지고 있다. 이러한 정의는 방법론적으로 더 나을 뿐 아니라, 이론적으로 보다 중요한 함의를 가지고 있다. 그것은 이 정의가 주인-대리인 관계에 대한 이론을 기반으로, 준대통령제가 대통령제, 의회제와 엄격히 구별되는 위임-책임의 관계를 설계하고 있음을 보여주고 있기 때문이다. 이러한 정의에 의하면, 준대통령제가 대통령이 외정 수상이 내정을 담당하는 이원정부제이자 분권형 대통령제라는 이해는 준대통령제의 한 하위유형이 택할 수 있는 매우 특수한 성격을 마치 준대통령제의 보편적 성격인양 혼동하게 하는 것으로서, 이와 같은 협소한 이해는 준대통령제의 다양성을 탐구할 수 있는 우리의 노력을 저해할 위험을 안고 있다.

It appears that there exists a big gap in the understanding of semi-presidential regimes between domestic and international academic communities. This paper tries to bridge the gap by critically introducing the international scholarly efforts on semipresidential regimes for the past 30 years. The concept of semi-presidentialism, since first proposed by Duverger, has produced serious debate, despite its apparent numerical expansion after the cold war era. The conceptual confusion was due to the intrinsic ambiguity of the presidents considerable power. Recently, a new definition which eliminates the controversial element completely has been widely accepted in the academic community. This new definition, proposed by Elgie, has been assessed that it is not only more methodologically advanced but also rich in theoretical imports. Based on the theory of the principal-agent relationship, the new definition makes it clear that semi-presidential regimes are designed to provide different delegation-accountability relationship to citizens than those of presidential and parliamentary regimes. In light of this new definition, our understanding of semi-presidential regime such that it is a regime where president deals with foreign affairs and prime minister makes a decision on domestic issues confuses general characteristics of semi-presidentialism with very peculiar characteristics of some subtype of semi-presidentialism. This narrow understanding is dangerous because it might impede our effort to study the variety of semi-presidential regimes.
