인도의 사회적취약층에 대한 우대정책의 사례연구 : 기타후진계층(OBC)에 대한 할당정책의 이해

Abstract

사회적 취약층에 대한 우대정책의 해외사례로서 인도의 우대정책을 이 연구에서는 다루고 있다. 일반적으로 잘 알려져 있지 않지만, 인도는 우대정책을 전 세계적으로 가장 먼저 그리고 가장 강력하게 시행하고 있는 국가에 해당한다. 이 연구는 인도의 우대정책 중 특히 차상위계층에 해당하는 기타후진계층에 대한 할당정책을 구체적으로 살펴보고 있다. 이를 위해서 우리에게 생소한 기타후진계층(other backward classes:OBC)이란 어떤 부류의 사람들을 이야기하는지를 먼저 살펴본 다음에, 지정카스트와 지정부족에 뒤이어 이들에게 우대정책의 일환으로 할당정책을 도입하게 된 역사적 과정을 살펴보고, 우대정책의 내용을 교육부문과 공직부문으로 나누어 구체적으로 검토한다. 그러고 나서 이러한 우대정책의 효과와 문제점을 보기 위하여 도입결과 공공부문에서의 공직점유율이 사회집단별로 어떻게 변경되었는지 알아보는 동시에 기타후진 정책에 대한 할당정책의 문제점을 살펴본다. 이러한 연구가 비단 우대정책에 대한 관심의 제고만이 아니라 한국 정치학계에서 상대적으로 부족한 인도에 대한 연구의 심화 에 기여하였으면 한다.

This study explores the affirmative action program for the weaker sections in India, in particular, the so-called other backward classes (OBCs). India introduced, even if not well-known, the most comprehensive and strongest type of affirmative action program earlier than elsewhere in the world. This study focuses on the reservation policy for the OBCs among other Indian affirmative action programs. It begins by addressing the issues of who the OBCs are and how they are defined and differentiated from other social groups or classes. Then, it discusses the historical and constitutional context in which reservation policy was extended to the OBCs in addition to the other much more backward social classes, that is, the scheduled castes (SCs) and the scheduled tribes (STs). It continues to deal with the details of reservation policy for the other backward classes in the fields of higher education and public employment. Finally, it concludes with the effects of reservation policy and the problems with its implementation process including the issue of creamy layers.
