국제친권⋅후견법의 동향과 우리의 입법과제 : Trends of International Parental Authority and Guardianship Law and Koreas Future Legislation

Abstract
근자에는 결혼이주여성의 증가에 따라 한국에 거주하는 외국 아동이 늘고 있고, 외국에 거주하는 한국 아동들도 늘고 있다. 따라서 아동의 국제적 보호를 다루는 국제친권⋅후견법의 중요성이 점차 커지고 있으나, 한국에서는 국제적 아동보호의 문제에 대한 관심은 별로 크지 않다. 그러나 근자의 아동학대 사건들은 한국 사회가 아동의 보호에 커다란 관심을 기울이게 되는 중요한 계기를 제공하였다. 앞으로는 국제적 아동보호의 문제가 중요한 관심사가 될 것이다. 여기에서는 국제사법을 중심으로 한국의 국제친권법과 국제미성년자후견법(양자를 묶어 국제친권⋅후견법)의 현황을 살펴보고(Ⅱ.), 헤이그 국제사법회의의 1996년 부모책임 및 아동의 보호조치와 관련한 관할, 준거법, 승인, 집행 및 협력에 관한 협약(아동보호협약)을 중심으로 국제친권⋅후견법의 국제적 동향을 논의한 뒤(Ⅲ.), 한국의 입법과제(Ⅳ.)를 논의한다. 여기에서 국제친권⋅후견법은 친권⋅후견과 관련된 광의의 국제사법을 말하므로 그에는 국제재판관할, 준거법과 외국재판의 승인 및 집행은 물론 국제공조가 포함된다. 아동보호가 문제되는 사안에서는 보호조치를 취할 국제관할, 보호조치의 승인 및 집행과 국제공조 등의 절차법적 쟁점이 우선 문제된다. 아동보호협약은 법원만이 아니라 행정당국이 하는 보호조치와 그를 위한 국제재판관할, 준거법, 그의 승인 및 집행과 그를 위한 국제공조를 포함하므로 그중에는 민사사건의 범위를 넘는 것이 있다. 아동보호협약과 비교하면 현재 한국의 국제친권⋅후견법은 미흡하다.
In recent times, the number of foreign children who reside in Korea is increasing with the increase of the number of migrant foreign women who come to Korea for marriage and the number of Korean children who reside in foreign countries is also increasing. In the past, protection of children in the international context did not draw much attention in Korean society. However, recent cases of child abuse, in particular the Ulsan step mother case has offered opportunities to Korean society to pay more attention to the protection of children. Accordingly, in the future the protection of children in the international context will be the focus of Korean society. In this article, the author reviews the current provisions on parental responsibility and guardianship of the Private International Law Act of Korea (PILA)(Chapter Ⅱ.), international trend as reflected in the Convention on Jurisdiction, Applicable Law, Jurisdiction, Applicable Law, Recognition, Enforcement and Co-operation in Respect of Parental Responsibility and Measures for the Protection of Children (Convention) of 1966 of the Hague Conference on Private International Law (Chapter Ⅲ.) and the direction of Koreas future legislation (Chapter Ⅳ.). The international parental authority and guardianship law in its broad sense referred to in this article includes jurisdiction, applicable law, recognition, enforcement and co-operation in respect of parental authority and guardianship.
