롤즈(J. Rawls)의 '정치적 정의관'에 내재되어 있는 '배경적 정의질서': 구성개념을 중심으로

Abstract

이 글은 롤즈의 정치적 정의관에 내재되어 있는 배경적 정의질서 구성내용과 특성에 대해 살펴본 것이다. 배경적 정의질서는 정의상황의 최초정의질서로서 사회기본구조에 담겨 사회구성원들 및 협회 사이의 인적, 물적 교류관계가 준거해야 할 사회기본질서에 정의로움의 조건을 확보해준다. 이 글은 정의로움의 조건을 규정하는 배경적 정의질서의 구성개념들에 대한 논의를 중심으로 구성되었다. 특히, 롤즈의 논의에서 분명하게 밝혀지지 않은 다음 사항들에 그 초점을 맞추었다. 첫째, 질서주체들 사이의 질서에 대한 규명이다. 둘째, 롤즈가 질서수립방법으로 동시에 제시하고 있는 실제적 사회계약으로서의 합의와 가설적 사회계약 사이의 관계와 변별이다. 셋째, 롤즈의 논의에 동시에 등장하는 두 종류의 질서관할력 – 자율적 복종에 조응하는 권위와 타율적 복종에 조응하는 강제적 정치권력 - 사이의 관계와 변별이다. 결어에서는, 이상의 논의를 바탕으로 하여, 배경적 정의질서가 어떻게 사회전반의 질서들로 침투, 확산되어 사회기본질서체계를 구성하는지 그 윤곽을 밝혀보았다.

This essay is to clarify the content as well as the features of background justice-order entailed in Rawls conception of political justice. Background justice-order, as the order in the first justice circumstances, secures the just background conditions for the fundamental social orders through the basic structure of society. Moreover, it prevents the interpersonal and material transactions between the citizens as well as the associations from becoming gradually degraded into unjust ones in the course of time. This essay consists of discussions about the conceptual constituents of background justice-order: They are about the eligible order-subjects along with the just order between them; about the just way in establishing fundamental social orders. They are focused especially upon the following issues that are addressed or explained not in a clear enough way in Rawls discussions: First, upon the just order between the eligible order-subjects; second, upon the relationship as well as the differentiation between agreement as an actual social contact and hypothetical social contract, both of which are suggested at the same time in Rawls discussion; third, as the same kind issue as in the second one, between authority which is correlated with willing compliance and coercive political power which is the correlative of the coercive subjection. Finally, this essay, based on the above discussions, attempts to map out the outlook of how the background justice-order infiltrates into social orders all over and is incorporated into the social order-system in a consistent way.
