국방과학기술료(Royalty Fee) 징수정책의 문제점과 개선방안

Abstract

국방과학기술료는 1995년 도입되었으나 국가방위산업 육성을 위해 10년 간 유예되었다가 2006년 시행되었다. 이후 진행핀 터키 전차기술수출협상 등 방산기술수출사례들븐 기술료제도에 따른 규정 및 운용상의 문제점을 제기하고 개선방안을 모색하는 계기카 되었다. 국방기술료 징 수에 대해서는 국방기술발전을 위해 규정대로 기술료를 징수해야 한다는 기술보유기관의 입장 과 기술료 징수가 방위산업발전과 빙산수출 증대에 부정적 영향을 미친다는 방산업계의 주장이 대립되고 있지만 현재는 계획대로 기술료를 집수하되 업체의 요청에 따라 감면하는 방향으로 시행되고 있다. 그러나 기술료징수 규정이 명확하지 않아서 국방연구결과물의 귀속소유권, 징수 된 기술료 사용, 기술료 감면대상과 절차상의 문제 등은 여전히 이해당사자들 간의 갈등을 야기 하는 현안으로 남아있고. 방산수출시 국방연구기술 실시에 따른 국방기술 유출가능성을 효과적으로 통제할 방안에 대한 논의도 필요한 실정이다. 방산수출 세계 10위권 진입을 앞둔 현 시점 에서 국방연구기술 발전과 수출증대의 선순환구조가 정착되도록 국방기술료의 합리적 운용을 위한 관련규정 개정 등 제도적 개선방안이 모색되어야 한다.

The collection of royalties for defense technologies was first adopted in 1995 in the Republic of Korea and has been enforced from 2006, following a 10-year suspension. Negotiations for the export of Korean technologies and operational know-how for the production of main battle tanks in Turkey revealed the practical aspects of system for collecting defense technology royalties, a system that must be harmonized with the promotion of defense exports. Following disputes between the defense industry and the Agency for Defense Development (ADD) over the allegedly inadequate collection of defense technology royalties, the h o sides reached agreement that royalty fees may be reduced or exempted in certain caws. Still, the problems caused by the obscure standards for collecting royalties remains to be resolved. It is necessary to cl-eate an effective mechanism to prevent the potential drain of defense technoIogies that might result from growing defense exports. This paper aims to review critical issues related to the colIection of defense technology royalty fees, and to examine the government`s efforts to facilitate further development of defense industry.
