자율 무기 체계의 책임 귀속 문제

Abstract

자율 무기 체계(AWS)는 많은 국가들에서 일종의 사활적 이익으로 고려되고 있으며, 그 개발과 배치에 박차를 가하고 있다. 그러나 그 사용에 있어 윤리적인 문제가 야기된다는 우려가 있어왔다. 특히 AWS의 사용 자체에 본질적으로 윤리적인 결함이 있다는 주장이 제기되어왔으며, 이는 대표적으로 로버트 스패로우(Robert Sparrow)의 두 편의 논문에 의해 지적되었다. 본고의 목적은 스패로우의 주장을 차단하고, AWS가 본질적으로 윤리적 문제를 일으키지 않을뿐더러 책임 간극도 발생하지 않는다는 것을 보이는 데 있다. 이를 위해 우선 스패로우의 주장을 검토하면서 우선 책임 간극 논변을 살펴 볼 것이다. 스패로우는 책임 간극 논변을 통해 AWS가 전쟁 범죄를 일으키게 되면 설계자, 지휘관, AWS가 모두 책임을 질 수 없는 상황이 발생하므로 AWS의 사용이 윤리적으로 문제가 있음을 지적한다. 그리고 나아가 AWS를 적 전투원에게 사용하는 것조차 윤리적으로 문제가 있다고 주장한다. 이에, 나는 스패로우의 주장이 갖는 문제점을 설명하고, 그에 반대하는 다른 학자들의 견해를 살펴볼 것이다. 그리고 마찬가지로 그 주장들도 성공적이지 않음을 보일 것이다. 그 후, 지휘 책임이라는 개념을 도입하여 성공적으로 AWS 전쟁 범죄 사례의 책임이 지휘관에게 귀속될 수 있다는 것을 보이고자 한다. 따라서 책임 간극이 존재하지 않는다는 것을 보일 것이다. 이어 AWS의 사용에 대한 간략한 제언으로 논문을 마무리하고자 한다.

In many countries, the autonomous weapon system(AWS) is considered a kind of tool for national vital interest. So, many countries are trying to research and deploy AWS. However, there are some worries about some ethical problems with AWS. Especially, there are some arguments for the claim that using AWS is intrinsically unethical. Robert Sparrow is one of thoes who argued that using AWS is intrinsically unethical, within his two papers about AWS. In this paper, I refuse Sparrows argument. Also, I show that AWS is not intrinsically unethical, and there is no responsibility gap in deploying AWS. I first introduce Sparrows Responsibility Gap Argument. Sparrow claims that if AWS commits war crime, anyone who related the situation(Programmer, Commander, AWS itself) couldnt get a responsibility about crime, so there are some ethical problems in using AWS. Furthermore, Sparrow says that AWS is an intrinsically unethical weapon system, so it would be immoral even if AWS engage with the legal combatant. However, I show that Sparrows arguments have some faults, and can't explain his own scenario. I introduce other ideas, which can't address the problem either. After that, I show that a commander is not only culpable but also responsible for a war crime committed by AWS, in light of the notion of Command Responsibility'. The upshot will be that responsibility gets assigned to commander in which case no responsibility gap remains with regard to deploying AWS. I then finish the paper by proposing a brief restriction about AWS.
