중국의 외국인 권리보호에 관한 연구

Abstract

세계화의 영향으로 중국에 체류 중인 외국인의 수는 매년 꾸준히 증가하여 84만 명을 넘어섰다. 이러한 수치는 인구강대국인 중국의 총 인구수에 비하면 극소수에 해당한다고 볼 수 있지만 중국도 저출산 고령화로 인한 문제에 직면하여 있고 노동인구의 감소와 더불어 고학력인구의 증가로 인한 노동력 부족현상이 발생하고 있다. 아직 공식적으로 외국인의 유입사유와 체류자격 등에 대한 자세한 통계자료가 제한적이나 이미 우리 삶의 곳곳에서 외국인이 사회구성원으로 자리매김하고 있다. 그렇다면 이러한 변화 속에서 중국의 외국인에 대한 권리보장이 어느 정도 이루어지고 있는지에 대한 문제의식을 가지고 이 글을 시작하였다. 그동안 중국은 우수인재를 유치하기 위한 지원을 적극적으로 수행하여 왔다. 다만 현재와 같이 인재유치에 치중하여 정책을 펼쳐나가기에는 이미 3비 외국인의 문제가 심각하게 드러나고 있음을 감지해야 한다. 그 외에도 투자, 학업 등 목적으로 일시적으로 체류한 후 본국으로 돌아가는 외국인보다는 중국에서 삶의 터전을 잡고 살아가고 있는 외국인들의 권리보장문제에도 관심을 기우릴 필요가 있다. 그리고 중국의 불법체류 외국인의 급격한 증가로 인권침해가 야기되고 있는 문제와 관련하여 이들을 대상으로 효율적으로 관리하고 불법체류자도 인간으로서 최소한의 권리가 보장되어야 할 것이다. 구체적으로 외국인에게 각 법률에서 헌법상 권리가 실질적으로 보장되고 있는 지를 파악하고자 외국인의 입국, 체류, 출국과정에서 외국인의 기본권 보장문제를 살펴봄으로써 앞으로 중국도 다양한 목적을 가지고 살아가고 있는 외국인의 증가를 대비하여 비교법적으로 한국의 외국인 기본권 보호에 관한 학계의 논의, 관련법제도 함께 고찰하였다. 결론적으로 중국의 외국인관련 법제는 일관된 체계성이 결여되어 있고 실용주의를 기초로 시대별 상황에 따라 상이한 외국인 정책을 펼쳐왔다. 인구대국인 중국에서 외국인에 대한 통제의 필요성이 있다고 하여도 외국인을 바라보는 시각은 중국헌법상 기본원리로서 인권의 존중과 보장이다. 중국헌법 제32조에 따른 외국인의 합법적 권익에 대한 보장을 근거로 삼아 외국인을 권리주체로서 인식하는 것이 관련법 제정과 정책을 마련하는데 있어 선행되어야 할 과제이다.

Due to the influence of globalization, the number of foreigners residing in China has steadily increased every year, exceeding 840,000 people. Compared with the total population of China as a populous country, these figures can be said to be only a very small number, but China is also facing problems brought about by low fertility and aging, and the decrease of the working population, coupled with the increase of highly educated population leads to the phenomenon of labor. Although detailed statistical data on the reasons for the inflow of foreigners and their status of residence are still limited, they have already become members of society in every corner of our lives. Then, I started this article with the question of how much protection of the rights of foreigners are guaranteed in China amid these changes. Until now, China has actively conducted support to attract talented people. However, as now, we only pay attention to attracting talents to carry policies, and the problem of three non-foreigners is already being seriously revealed. In addition, it is necessary to pay attention to the issue of guaranteeing the rights of foreigners living in China rather than foreigners who temporarily stay for investment or study and return to their home countries. At the same time, in relation to the problem of human rights violations caused by the rapid increase of illegal foreigners in China, we should effectively manage them and guarantee the minimum rights of illegal foreigners as human beings. Specifically, in order to determine whether the constitutional rights of foreigners are actually guaranteed in each law, China will prepare for the increase in the number of foreigners living with various purposes in the future by examining the issue of guaranteeing the basic rights of foreigners in the process of entry, stay, and departure of foreigners. Therefore, this paper examines the academic discussion on the protection of basic rights of foreigners in Korea and related legal system comparatively. In conclusion, China's foreigner related legislation lacks consistent systematicity and has implemented different foreigner policies based on pragmatism according to the situation of different times. As a populous country, apart from the need to control foreigners, the perspective of treating foreigners is the basic principle of the Chinese Constitution, that is, respecting and safeguarding human rights, protecting foreigners' legitimate rights and interests according to Article 32 of the Constitution, and formulating relevant laws and policies, which are the first problems to be solved.
